I Richard Drinkwater of ffarnham in the County of Surrey Esquire do hereby revoke all former wills by me made and declare this to be my last Will and Testament I direct that I may be interred in the same vault where the remains of my late Wife are deposited and that my funeral may be conducted in the same manner in which hers was and I bequeath the following legacies that is to say To my Nephew Richard Bacon fforster and his two sisters the son and daughters of my Sister Mary Lilliot Bacon fforster widow the sum of two hundred pounds sterling apiece To my friend William Newnham of ffarnham aforesaid surgeon the sum of one hundred pounds sterling To my friends James Stevens James Shotter and John Mainwaring Paine all of ffarnham aforesaid Gentlemen my Executors hereinafter appointed the sum of fifty pounds sterling apiece as recompense for the trouble they will have in the execution of this my will To my servants Ann Bond and Mary Wells the sum of forty pounds sterling apiece and to my servant Ann Hinton the sum of nineteen pounds and nineteen shillings sterling and I bequeath all my wearing apparel and clothes to the said Ann Bond and Mary Wells and direct that the same be equally divided between them at the discretion of my said executors within fourteen days after my decease in case such servants respectively shall be living in my service at the time of my decease and first that all the aforesaid pecuniary legacies be respectively paid and retained within three calendar months from the day of my decease and I bequeath the yearly and other proceeds arising from my shares in the Itchen Navigation in the County of Southampton unto Hannah Pyott spinster the sister of my late Wife during her life and all and singular my messuages buildings lands tenements hereditaments and real estate and all the Residue of my goods chattels rights receipts and personal estate whatsoever and wheresoever including therein after the decease of the said Hannah Pyott my said shares in the Itchen Navigation aforesaid after payment of my funeral and testamentary expenses and debts I devise and bequeath unto my brother John Drinkwater now residing in Upper Canada his heirs exors admors and assigns absolutely but in case the said John Drinkwater shall not return to England and apply personally to my Executors hereinafter appointed or one of them within twelve calendar months from the day of my decease then I devise and bequeath my said real and residuary personal estate unto the said James Stevens James Shotter and John Mainwaring Paine their heirs exors admors and assigns according to the nature and quality thereof respectively upon trust that they or the survivors or survivor of them or the heirs exors or admors of such survivor do and shall with all convenient speed after the expiration of the said six months and as to the the said shares in the said Itchen Navigation after the decease of the said Hannah Pyott absolutely sell call in and convert the whole thereof into money by such ways and means as to them shall seem expedient and for facilitating the sale of my said real estate I do hereby declare that every receipt in writing of the said James Stevens James Shotter and John Mainwaring Paine or of the trustees or trustee for the time being acting in the execution of the trusts of this my will for all or any part of the purchase monies to arise by such sale shall effectually discharge the person or persons to whom the same shall be given his her and their heirs executors admors and assigns from all liability on account of the misapplication or nonapplication of such purchase monies or any part thereof and as to the monies arising by such sale and conversion of my said real and residuary estate and which shall otherwise come to the hands of my said trustees by virtue of this my will upon trust after payment thereout of all the costs and expenses attending the execution of the aforesaid trusts to pay the whole residue thereof unto my said brother John Drinkwater his exors admors or assigns and I bequeath the same accordingly and I devise and bequeath to the said James Stevens James Shotter and John Mainwaring Paine their heirs executors and admors all the estate which at the time of my decease shall be vested in me upon any trusts or by way of mortgage to hold the same upon the several trusts and subject to the equity of redemption which shall be subsisting or capable of taking effect therein but the money secured by or upon any such mortgages shall be considered and taken as part of my personal estate And I appoint the said James Stevens James Shotter and John Mainwaring Paine Executors of this my Will and I declare that the said James Stevens James Shotter and John Mainwaring Paine and the survivors of them and the exors or admors of such survivor shall be chargeable respectively for such monies only as they respectively shall actually receive by virtue of the trusts hereby in them resposed not withstanding their or either of their joining in giving or signing any receipt or receipts for the sake of conformity and that any one or more of them shall not be answerable for the other of them or for involuntary losses and also that they may with and out of the monies which shall come to their respective hands by virtue of the trusts aforesaid retain to and reimburse themselves respectively and also allow to his or their trustee all damages or expenses which any or either of them shall or may sustain disburse or be put unto in the execution of the
