The Will and Inventory of William Downall

 

In the name of god Amen I Will’m Downall of Hadocke in the county of Lancast’r yeoman being sicke in body yet of good and perfect memorie praise bee to god for the same doe constitute ordaine and make this to be my last will and testament in manner and forme following  And first and principally I commend my soule into the hands of Almighty god my onely creator fully trusting that by and through the passion and sufferings of Jesus Christ my alone saviour and redeemer I shall receive full pardon and remission of all my sinnes and my body I comit to the earth from whence it came to bee buryed at my parish Church of Winwicke there to remaine in the bosome of the earth untill it shall please god to raise it up againe abody of immortalitie And as for and concerneing all such goods debts cattles chattles and utenselles as it hath pleased god to bestowe on mee in this life it is my mind and will to dispose of in manner and forme following And first and principally it is my mind that my debts and funerall expences befully discharged and paid forth and out of the same and theparts it is my mind and remainder and residue of all my goods debts cattles chattles and utensells over and above the dischargeing of my debts and funerall expences it is my mind and will shall be devided into Three parts and one of the third part I give unto Elizabeth my wife and the other two parts it is my mind and will to dispose of in manner and forme heareafter expressed Item I give unto Mary the daughter of George Platt of Burtonwood the sum of £4 Item I give unto Elizabeth Platt daughter of the said George £10 and the same to be paid as they shall respectively paid as they shall respectively attaine to the age of one and twenty yeeres and if either of the said Daughters doe happen to dye before they attaine to the age of one and twenty yeeres theire part and portion soe deceased shall fall to the survivor of them Item I give to Peter Downall my sonne the sum of Thirty pounds for the use and behoofe of Katherine Bucke and the same to be given and paid unto her when and assoone as shee shall accomplish the age of one and twenty yeeres and if it shall happen th’t the said Katherine Bucke shall dye before shee attaine to the age of one and twenty yeares th’t then and in suchcase the said sum’ of Thirty pounds shall be equally divided amonghest the children of Thomas Chadocke Peter Downall and George Platts two daughters  Item I give unto John Chadocke sonne of Tho: Chadocke  £5  Item I give unto Thomas Chadocke Peter Chadocke Will’m Chadocke Joseph Chadocke children of the above named Thomas Chadocke each of them £10 apeece and if it shall happen that if Anna the wife of the said Tho: Chaddocke shall have no more children th’t then and in suchcase I give unto Will’m Chadocke one of the children of the afore named Tho: Chadocke the sum of £10 more but if it happen for Anna my daughter to have more children then I give to the first child the sum of £10 which was added to Will’m Chadocke all of which said parts and portions to be paid as they respectively shall attaine to the age of one and twenty yeeres And if any of the above named children shall happen to dye before they accomplish the age of one and twenty yeeres th’t then his or theire parts and portions soe deceased shall be equally devided amongst the children that doe survive Provided never the lesse th’t whereas Thomas Chadocke my sonne in law hath power by his deed of feofment to charge his eldest sonne with any any sum or sumes of money whatsoever not exceeding the sum of Three hundred pounds now the said Thomas Chadocke upon further and serious consideration with himselfe as also for the consideration of the legasies above granted  and given to the children of the the said Thomas Chadocke as aforesaid did promise and give under his hand and seale before 2 or 3 credible witnesses  to me the above named Will’m Downall he the said Thomas Chadocke will not charge by any his act or deed his eldest sonne with any sum whatsoever above the sum of Two hundred pounds but and if it shall happen th’t the said Thomas Chadocke shall deny relinquish renounce and alter his said promise and writing as above said and shall charge his eldest sonne with any sum or sum’s of money whatsoever above the sum of Two hundred pounds by his last will and testament or any other his act or deed that then and in such case the legasies above granted and given to Tho: Chadocke Peter Will’m and Joseph Chadocke children of the said Thomas Chadocke shall be utterly void frustrate and of none effect and the said legasies of Thomas Peter Will’m and Joseph Chadocke shall begiven and paid unto John Chadocke one of the sonnes of the above names Thomas Chadocke  Item I give unto Peter Downall my sonne both the Iron grates in the house and parlor and all the sieleing within the fire house the table in the nooke and the table in the house and the salt arke and the great meale arke in the chamber and the meale arke in the parlor and all plowes carts harrowes trease and all other things belonging to the teame and all the loose timber about the house and my box or deske which I keepe my writeings in  Item I give to Anna Chadocke my daughter one seiled bed or to have Twenty shillings in lew of the same and also one chest  Item I give to Mary Platt daughter of George Platt one seild bed or to have Twenty shillings either at the day of her marriage or when shee shall accomplish the age of one and Twenty yeeres in lew of the same Item I give unto Katherine Bucke one seild bed or Twenty shillings in lew fro the same Item I give unto George Platt my sonne in law Twelve pence in full of all legasies giftts and bequests whatsoever  Item I give unto Elizabeth Platt daughter of the said George Platt one chest  Item I give unto John Chaddocke sonne of Thomas Chaddocke one chest that is in the roome over the house  Item I give to the poores stocke of the towne of Hadocke the sum of five pounds and the interest thereof to bee given to the poore of the same for ever Item I give to Elizabeth Downall daughter of Peter Downall my sonne the sum of £5  Item I give to Mary Daownall daughter of the said Peter the sum of £5 and the rest and residue of all my said goods and chattles whatsoever over and the discharging as aforesaid I wholly give and bequeath unto Anna Chadocke my daughter and Mary Platt daughter of George Platt my sonne in law equally to be devided betwixt them  And more over it is my mind and will that if any the persons to whom I have given any legasie to as aforesaid shall or doe wrangle or be contentious that my mind and will may not be peacably and quickly be executed and performed as my trust is in my execut’r heareafternamed that then and in suchcase his/her or their parts portions or legasies soe given shall be void and of none effect upon the payment or tender of one shilling to any one that shall soe wrangle or contend  And I doe here by constitute ordaine appoint and make Peter Downall my sonne to bee my true and lawfull executor to execute and performe this my last will and testament as my whole trust is in him  And I likewise intreat Thomas Chadocke of Chadocke Hall my sonne in law and John Potter of Ashton the younger to bee overseers of this my said last will and testament that the same be executed performed and kept accordinge to my mind and will herein declared And for the better strengthinge and corrobaratinge hereof I have here unto set my hand and seale the one and Twentieth day of January in the Three and thirtieth yeere of the Raigne of King Charles the Second and in the yeere of our Lord 1681
