The Will of Mary Dovey

 

This is the last Will and Testament of me Mary Dovey of Boughton ffields in the Parish of Saint John in Bedwardine in the County of Worcester Widow I resign my soul into the hands of God that gave it trusting alone to the merits of my Lord and Saviour Jesus Christ for salvation I direct that all my just debts and funeral and testamentary expences be paid as soon as conveniently after my decease I direct my executors hereinafter named to sell and dispose of all my household goods plate linen china and furniture either by public sale or private contract as to them shall seem meet as soon as convenient after my decease and I direct that the net proceeds thereof shall form part of the residue of my Personal estate Whereas under the Will of my late Husband William Dovey of Boughton fields aforesaid Cabinet maker deceased bearing date the fifteenth day of January one thousand eight hundred and thirty three and which was proved in the Consistory Court of Worcester the twenty second of September one thousand eight hundred and thirty seven one half of the residue of the proceeds arising from the sale after my decease of a certain freehold messuage or tenement garden and premises situate in Boughton fields aforesaid which I now occupy is directed to be paid and applied by the Trustees therein named and by my last will and testament in writing shall or may direct limit or appoint or give or bequeath the same Now therefore I do hereby direct limit and appoint and also give and bequeath the same unto and equally between and amongst my six nieces Maria Parlour Mary Masters Sarah Trig Mary Davis Sarah King and Ann Baldwin and their respective executors administrators and assigns share and share alike as Tenants in common and not as joint Tenants with benefit of survivorship amongst them in case any or either of them shall die without issue in my life time as hereinafter mentioned And whereas my said husband having died in my life time I am therefore absolutely entitled under and by virtue of my marriage settlement with my late husband bearing date the fourth day of July one thousand eight hundred and eighteen to one third of certain leasehold premises situate and being No 7 in Park Place St Mary le Bone in the County of Middlesex for the residue of a certain term of ninety three years and three quarters of a year wanting thirty days from Midsummer day one thousand eight hundred and seven under a certain Indenture of Lease bearing date the first day of August in that year and which premises were purchased by Messieurs John Timmings and Jabez Allies as Trustees under my said marriage settlement with the sum of two hundred pounds part of the sum of two hundred and sixty pounds secured by such settlement and such premises were assigned to them upon the Trusts of the said Settlement by Indenture dated the eighth day of ffebruary one thousand eight hundred and nineteen And whereas I am likewise absolutely entitled to the sum of Sixty two pounds and sixteen shillings new three and a half percent annuities standing in the names of the said Trustees under such settlement which was purchased by them with the aforesaid sixty pounds the residue of the said sum of two hundred and sixty pounds Now therefore I do hereby direct and appoint that the said sixty two pounds and sixteen shillings new three and a half percent annuities shall sink into and form part of the residue of my personal estate and with respect to my said third of the said leasehold premises situate in Park Place aforesaid I hereby give and bequeath the same to the said John Timmings of the City of Worcester Gentleman and Jabez Allies late of London and now of the said City and the survivor of them his executors administrators and assigns subject to the ground rent and other outgoings payable thereout and to the subsisting underlease to Mr John ffinleyson dated twenty third April one thousand eight hundred and thirty one Upon Trust to pay the rent and profits thereof unto and Equally between and amongst my brother John Simmons and my two sisters Sarah Benton and Margaret Bayley share and share alike for and during the term of their natural lives and upon the death of one of them the two survivors to be equally entitled to the said rent and profits for their lives and upon the death of two of them the survivor to be entitled to the whole of the said rent and profits for his or her life And from and after the decease of the survivor of them Upon Trust that they my said Trustees or the survivor of them his executors administrators and assigns do and shall with all convenient speed sell and dispose of my said one third share of the said leasehold premises in Park Place aforesaid either by public sale or private contract as to them or him shall seem meet for the most money that can be reasonably had or gotten for the same and do and shall from the proceeds arising from such sale in the first place pay all costs charges and expences attending the said sale and of the execution of the trusts of this my will and I hereby declare that the residue of the money arising from such sale shall form part of the residue of my personal estate and I hereby declare that the receipt or receipts in writing of they my said Trustees or the survivor of them his executors administrators and assigns shall be a good and sufficient discharge or good and sufficient discharges to the purchaser or purchasers of the said trust premises for so much money as such receipt or receipts shall be acknowledged or mentioned to be received and that such purchaser or purchasers shall not be bound to see to the purchase money or be answerable for the misapplication or non application thereof And that my said t Trustees or the survivor of them his executors administrators and assigns may reimburse themselves and himself out of any part of my estate and effects all their and his costs charges and expences attending the execution of the Trusts of this my will I give and bequeath unto my Niece Elizabeth Simmons the sum of Ten pounds to be paid within twelve Calendar months after my decease And with respect to all the Rest Residue and Remainder of my estate and effects whatsoever and wheresoever I give and bequeath the same unto and equally between and amongst my said nieces Maria Parlour Mary Masters Sarah Trig Mary Davis Sarah King and Ann Baldwin and their respective executors administrators and assigns share and share alike as Tenants in common and not as joint Tenants as Tenants in common and not as joint Tenants And in case any or Either of them the said Maria Parlour Mary Masters Sarah Trig Mary Davis Sarah King and Ann Baldwin shall happen to die in my lifetime leaving lawful issue then such issue shall be entitled to the share his her or their parent would have been entitled to if living And I hereby direct that the share or shares of such issue shall be paid to the Personal Representative or Representatives of such my niece or of each of my such nieces so dying in my lifetime leaving lawful issue as aforesaid and that the receipt or receipts in writing of such personal representative or representatives shall be a good and sufficient discharge or good and sufficient discharges to for the same And I hereby further declare and direct that until the sale of all my said leasehold property as aforesaid is effected the rents and profits thereof shall be paid to such persons as shall be entitled to receive the same in case the said property were then sold And I hereby nominate constitute and appoint the said John Timmings and Jabez Allies Executors of this my will and hereby revoke all former wills by me at any time heretofore made and declare this to be my last will and testament In witness whereof I have hereunto set my hand this tenth day of November in the year of our Lord one thousand eight hundred and thirty seven  _ Mary Dovey
