The Will of John Dovenor

 

John Dovenor of Middlesmoor Yorkshire, yeoman, died 27th November 1825

 

In the name of God, I JOHN DOVENOR do make and publish this, my last will and testament, in manner and form following. I give and devise to my friends LEONARD ROBINSON of the park in the township of Kettlewell in the county of York, Yeoman, and RICHARD THOMPSON of the township of Stonebeck Down in the said county, yeoman, all and every of my messuages, dwelling houses, lands, tenements and real estate and property of every denomination and of whatever nature or tenure and wheresoever situate with the rights, members and appurtenances to hold to them the said LEONARD ROBINSON & RICHARD THOMPSON their heirs, executors, administrators  and assigns for ever or for such estate and interests as I may have and enjoy therein upon the trusts and to and for the objects and intents and purposes hereinafter expressed or declared of or concerning the same, that is to say upon trust that they, my said trustees shall and do let my said estates and property at the expiration of the present lease to a good and sufficient tenant and at the best annual rent that can be reasonably obtained for the same for the term of five years and that they do let the same under a lease with good conditions and restrictions and with the express conditions and restrictions that no part of my land shall be plowed out or converted unto tillage and upon further trust that they, my said trustees, shall by and out of the rents of my said property pay unto my daughters MARY MAWER & ANN BURTON  and their assigns respectively during the terms of their natural lives the annuities or yearly sums of five pounds each clear of all deductions and also do pay to my daughter MARGARET WALKER and her assigns during the term of her natural life  the annuity or yearly sum of four pounds clear of al deductions to be paid in half yearly portions  at Mayday and Martinmass, commencing on the first of these days to arrive after my decease, and upon further trust .........  they pay and discharge all my just debts and engagements, my funeral expenses and the costs and charges of proving this my last will and testament of any form including the legacy or Kings duty, also the further legacy of fifteen pounds which I give and direct to be paid six months  after my death to each and every of my grandsons hereinafter mentioned viz: MATTHEW, WILLIAM,JONATHAN and JOHN sons of my daughter MARY MAWER.  JOHN, WILLIAM & LEONARD sons of my daughter ANN BURTON. JOHN and JAMES sons of my daughter MARGARET WALKER and JOHN, GEORGE and WILLIAM sons of my late son JOHN DOVENOR and upon the further trust that....  in trust for the sole use of my grandson JONATHAN DOVENOR, son of my late son JOHN DOVENOR, his heirs executors,assigns for ever

I give and bequeath all my household furniture, goods and chattels and effects, money and securities and othr personal estate whatosever to my said trustees to convert the same into money and to apply the same and my real estate in trust for my said grandson JONATHAN DOVENOR and I nominate the said JONATHAN DOVENOR residuary devisee and residuary legatee of this my will revoking all previous wills by me made. I constitute my said Trustees executors in trust of this my said will paying to themselves all expenses due in execution of the trusts

Codicil dated 5th August 1825

 

..............Instead of the annuities of five pounds  apiece to be paid to my daughters MARY MAWER and ANN BURTON I increase the sum to seven pounds.......... and instead of the annuity of four pounds to my daughter MARGARET WALKER I increase it to six pounds.... I do hereby express and direct that the said legacies shall be paid into their own hands and upon their own receipts and not otherwise (which said receipts shall be good in law not withstanding any coverture) and that the said annuities shall in no way be subject or liable to the control, debts or liabilities of their present of future husbands or husband
