The Will of Nathaniel Smyth Dobson

 

THIS IS THE LAST WILL AND TESTAMENT of me NATHANIEL SMYTH DOBSON of Harrington in the County of Cumberland Wholesale grocer. I appoint my dear wife Mary Dobson my son Charles William Dobson and my son in law Ernest Ramsay TRUSTEES AND EXECUTORS of this my will and they are hereinafter referred to as ‘my trustees’. I bequeath to my said wife absolutely my policy for two hundred pounds in the Scottish Provincial Insurance Company together with all bonuses thereon. I bequeath my watch and chain and my wearing apparel and all other my personal trinkets to my said son Charles William Dobson. I bequeath to my said wife for and during her life the use of all my household furniture plate china glass books pictures and other household effects And from and after her decease I bequeath to my said son Charles William Dobson my chest of drawers with scretaire desk and bookcase my corner cupboard and my chest of drawers (all of which were made by my late grandfather Thomas Harrison) also a silver goblet which belonged to my said grandfather and all my silver and plate marked ‘D’ it being my wish and desire that my said son should consider and deal with the said effects so bequeathed to him as family heirlooms. And as to all the rest of my household effects (after the death of my said wife) I bequeath the same unto and equally among my said son and my daughters Annie Fisher Carter and Elizabeth Isabella Ramsay. And it is my wish and desire that in the division of the said household effects any written instructions of my said wife in reference to such division shall be observed by my three children but I do not create any legal trust in respect thereof and I give and bequeath unto my said son Charles William Dobson All my half share and interest in the business of “Dobson and Musgrave” now carried on at Whitehaven in the said county Subject nevertheless to and charges with the payment of the sum of two pounds ten shillings a week to my said wife from the time of my decease and for long as she shall live. And from and after the decease of my said wife charged with the payment of the sum of five hundred pounds to each of my said daughters. I direct that my said daughters shall not call for the payment of the said sum of five hundred pounds for a period of five years from the death of my said wife but that until such sums are paid my son shall pay to each of my said daughters interest at the rate of five pounds per centum per annum on her said share of five hundred pounds and I declare nevertheless that my said son shall be at liberty to pay off the said sums within the period of five years on giving to my said daughters six calendar months notice of his intention to do so. I direct that the estate duty on the value of my said share in the said business shall be borne by my said son. I declare and direct that in the event of the death of my said son in my lifetime my share and interest in the business of “Dobson and Musgrave” shall be dealt with as part of the residue of my general estate. I devise all my real estate and bequeath all other my personal estate whatsoever and wheresoever not hereinbefore mentioned unto my trustees upon trust to sell and convert the same into money and after payment of my private debts funeral and testamentary expenses to invest the residue of the said moneys in the name of my trustees and upon further trust to permit my said wife to receive the annual income of the said moneys and investments during her life and from and after her death Upon trust for my said three children in equal shares. I declare that if any of my said three children shall die in my lifetime and any child or children of such child of mine shall be living at my death and attain the age of twenty one years the share of furniture and the share of residue to which each child of mine so dying would if living at my death have been entitled under the trusts aforesaid shall be held in trust for the child or children of such child of mine who shall be living at my death and if more than one in equal shares. I revoke all former wills IN WITNESS whereof I have hereto signed my name this third day of January one thousand nine hundred and twenty – NATHANIEL SMYTH DOBSON - Signed and acknowledged by the said Nathaniel Smyth Dobson as and for his last will and testament in the presence of us both present at the same time who at his request in his presence and in the presence of each other have hereunto subscribed our names as witnesses - J R THOMPSON Solicitor Whitehaven H FOX THOMPSON Solicitor Whitehaven.

On the 11th day of MARCH 1922 Probate of this will was granted to Mary Dobson, Charles William Dobson and Ernest Ramsay the executors.
