Notes:

  1. Testator was a son of Rev Timothy Dewell of Lydiard Tregoze, Wiltshire by his second wife Ann Saunders;

  2. Charles was testator’s youngest brother by the same parents;

  3. Thomas was testator’s eldest half-brother by his father’s first wife Elizabeth Knight; Henry (will proved 1731) and Richard (will proved 1717/8) were full brothers;

  4. Testator’s niece Elizabeth (1681-1733) was the eldest daughter of his eldest brother Thomas;

  5. Jonathan Rogers was testator’s first cousin, his mother being Elizabeth Saunders, sister of testator’s mother;

  6. Dr Anthony Saunders (c 1645-1719), the brother of testator’s mother, was Rector of Buxted, Sussex and of Acton, Middlesex.

Text:

In the name of God amen, this 2nd day of June 1723, I, Timothy Dewell of Lidyard Tregoze in the county of Wilts, Gent, being of perfect mind and memory (praised be God for it), calling to mind the mortality of my body and knowing that it is appointed for all men once to die, do make and ordain this my last will and testament in writing in manner and form following:

First, I commend my soul into the hands of Almighty God my maker, trusting through the merits of Jesus Christ my only saviour and redeemer to be made partaker of everlasting life and of a joyful resurrection, and resigning my body to the earth whereof it was made to be buried in Christian and decent manner with a tomb of stone upon my grave;

And as touching such worldly estate and goods wherewith  it hath pleased God to bless me in this life, I give and bequeath the same in manner and form following:

Imprimis, I give and bequeath unto my brother Charles Dewell all my lands and tenements lying in the tythings of Eastcutt and Westcott within the parish of Swindon in the county of Wilts which my father gave me and was my mother’s jointure and is now in the tenure and occupation of Ralph Thorn; I do give my said brother Charles Dewell during his natural life, provided always and on condition that he pay yearly unto my brother Henry Dewell during his natural life the yearly sum of twenty pounds per annum to be paid him half yearly and free from all taxes, and after the decease of my said brother Charles Dewell I do give and bequeath all those lands and tenements to my nephew Charles Dewell, son of my said brother Charles Dewell, to him and his heirs for ever, provided always and upon the same condition that he and his heirs pay yearly the aforesaid annuity of twenty pounds per annum to my said brother Henry Dewell during his natural life; and furthermore my will is that if my said nephew Charles Dewell happen to die before his father, then I do give and bequeath all those lands and tenements to my nephew Timothy Dewell, son of my said brother Charles Dewell, to him and his heirs forever after the decease of his father, he and his heirs paying the aforesaid annuity of twenty pounds per annum to my brother Henry Dewell during his natural life;

Item, all the rest of my lands and tenements in the tything of Eastcott in the parish of Swindon aforesaid, which I bought of John Wilde and is now in the tenure and occupation of Thomas Iles and Francis Hore I do give and bequeath to my brother Charles Dewell until his son, my nephew, Charles Dewell arrives and comes to the age of four and twenty years, and then I give and bequeath all those last mentioned lands and tenements to my said nephew Charles Dewell to him and his heirs forever; and furthermore my will is that if my said nephew Charles Dewell shall happen to die before he comes to the age of four and twenty years, then I do give and bequeath all those last mentioned lands and tenements to my nephew Timothy Dewell to him and his heirs forever when he comes to the age of four and twenty years;

Item, I give to my brother Henry ten pounds of good and lawful money of Great Britain to be paid him within twelve months after my decease, and two silver salt cellars called plate salts and a gold ring;

Item, I give to my niece Elizabeth Dewell, daughter of my brother Henry Dewell one hundred pounds of lawful money of Great Britain to be paid her when she comes to the age of thirty years or within twelve months after her marriage, which shall first happen, and I likewise give her my silver cup marked E.S/T.D and a gold ring;

Item, I give to my niece Ann Dewell, daughter of my brother Henry Dewell, fifty pounds of like lawful money to be paid her when she comes to the age of thirty years or within twelve months after her marriage, which shall first happen, and I likewise give her my silver cup marked D/R.A and a gold ring;

Item, I give my nephew Charles Dewell, son of my brother Charles Dewell, ten pounds to be paid him when he comes to the age of four and twenty years, and then I likewise give him my five guinea piece of gold and my silk ?Bed and all that belongs to it; and I likewise give him my great silver tankard and large silver salver that my uncle Dr. Saunders left me, and the least pair of silver candlesticks and snuffers, and my set of gilt silver tumblers and my silver plate and my largest silver chafing dish and my large upstand silver salt cellar; I give them to my nephew Charles Dewell when he comes to the age of four and twenty years and my gold stone ring;

Item, I give to my nephew Timothy Dewell, son of my brother Charles Dewell, the sum of one thousand pounds of good and lawful money of great Britain to be paid him when he comes to the age of four and twenty years, and I likewise give him my wrought ?Bed and all that belongs to it, and I likewise give him then my great wrought silver salver and my silver lion tankard and silver porringer and my little silver candlestick and the least of my silver chafing dishes and my silver ink box marked T.D and silver ??? box and a gold ring the stone R.D; I give them to my nephew Timothy Dewell when he comes to the age of four and twenty years;

Item, I give to my sister-in-law Ann Dewell the now wife of my brother Charles Dewell the sum of fifty pounds of lawful money of Great Britain and my little silver salver and a gold ring for her care she took of me in my illness;

Item, I give to my brother Thomas Dewell’s seven youngest daughters each five pounds and to my niece Elizabeth Dewell, eldest daughter of my said brother Thomas Dewell, I give her twenty pounds, to be paid her and her sisters within twelve months after my decease and out of the money they owe me; and I further give my said niece, Elizabeth Dewell, the eldest daughter of my brother Thomas Dewell, my large silver sugar box and a gold ring;

And I give my friend Mr. Jonathan Rogers and his wife each a gold ring;

Item, I give my niece Ann Beale’s three children, Charles, Ann and Elizabeth each five pounds to be paid them as they come to the age of one and twenty years;

Item, I give my cousin Hunt of Reading and her two granddaughters my cousin Holsted’s each three pounds to be paid to each of them within twelve months after my decease;

Item, I give to Nurse Bridget Ives of the parish of Acton in the county of Middlesex, who formerly lived with my uncle Dr Saunders and my brother Richard Dewell, I give her forty shillings a year during her natural life;

Item, I give to the poor of the parish of Lidyard Tregoze in the county of Wilts the sum of twenty pounds to be put out to use and the interest thereof yearly be given to the poor of the said parish against every Christmas day forever;

Item, I give to the poor of the parish of Swindon forty shillings and I likewise give to the poor of the parish of Lidyard Millicent twenty shillings;

Item, all the rest and residue of both my real and personal estate unbequeathed whatsoever I do give and bequeath unto my brother Charles Dewell, whom I do hereby make and ordain full and sole executor of this my last will and testament, desiring him to pay those small sums of money as in a paper he shall find given under my own handwriting; and I do hereby revoke, disanull, and make void all former wills and testaments by me heretofore made, in witness whereof I, the said Timothy Dewell, to this my last will and testament have set my hand and seal the day and year first above written.  // Timothy Dewell //

Codicil

I, Timothy Dewell, do give my brother Charles Dewell whom I have made full and whole executor of my last will and testament to pay and give the small sums of money to the persons hereinafter mentioned, witness my hand // Timothy Dewell //

Imprimis, I give Ralph Thorn, to be paid out of the money he owes me, three pounds;

Item, I give William Stone, to be paid him out of the money he owes me, three pounds;

Item, I give Thomas Lads, to be paid him out of the money he owes me, three pounds;

Item, I give to my tenants Thomas Iles and Francis Hord, I give each of them five shillings;

Item, I give my godson Thomas Jenner to be paid him out of the money his grandfather and aunt Elizabeth Jenner owe me, ten pounds when he comes to the age of one and twenty years; and to my friend old Mr. Jenner and to his daughter Mrs. Elizabeth Jenner I give each of them, to be paid out of the money they owe me, twenty shillings and not otherways;

Item, I give Richard Hale, to be paid him out of the money he owes me, ten shillings;

Item, I give my goddaughter Mrs. Luce Simson, to be paid her out of the money her mother Madam Vilett owes me, five pounds;

All of which above said sums of money I give upon condition they pay my executor the respective sums of money they owe me and not otherways;

Item, I give the eldest daughter of John Harper, late of Cricklett, which he had by his wife Ann Wilde, three pounds;

Item, I give my godson Mr. Thomas Richman to buy him a ring twenty shillings;

Item, I give the daughter of Mrs. Elizabeth Spencer as was, that is my goddaughter, twenty shillings;

Item, I give the daughter of John Holliday that is my goddaughter twenty shillings;

Item, I give my godson Selby, the son of Wm. Selby, twenty shillings;

Item, I give my godson John Pott to buy him a gold ring, twenty shillings;

Item, I give Mrs. Margaret, Mary and Winifred Wilde as was, the daughters of my old friend Mr. John Wilde, late of Cricklett, I give each of them twenty shillings;

Item, I give Richard Smith, Dina Smith, Eliz. Thrift, Anne Holliday, Winifred Pick, Richard Doare, Alice Doare, Mary Norton, Anne Alder, George Smith and Mrs. Wells, I give them each five shillings to buy them gloves;

Item, I give Elizabeth Moss, if she lives with my brother at my decease, twenty shillings and if she goes from my brother before my decease I give her then but five shillings;

Item, I give to my friend, old Mr. William Pettit of Buxted if he will be so kind as to help my executor to get my money and things in Sussex I then give him five pounds and to his wife and his daughter Mrs. Anne Pettit and Mrs. Mirabella Earle and to Susana Earle, I give them each a gold ring of about twelve shilling price.
