John Davile of Fencote in the Parish of Kirby Fleetham,
Yorkshire Gentleman
Died 10 feb 1744/45
I do make this my last will and testament as followeth.
As to my temporal estate wherewith it hath pleased God to bless
me with I give, devise and dispose thereof in manner following
First my will and pleasure is that my debts and funeral expenses
shall be discharged, and whereas by an agreement dated the
twenty sixth day of May 1741 between JOHN DAVILE of Fencote
the father and JOHN DAVILE of Doncaster, the son, Gentleman,
that the sum of two hundred pounds chargeable and hereby charged
upon the messuage house called Han house with the orchard and
garth on the backside of the said house and also the close
Little Green or Little Greens and the said close called the High
or West end of the cow pasture, the said JOHN DAVILE, the father
by the security and payment of two hundred pounds by the Deed
before mentioned gives, bequeaths and disposes by will of the
same to them or ... children as follows
First I give and bequeath to my son WILLIAM DAVILE the sum of
thirty pounds. Part of the two hundred pounds to be paid to him
at the end of twelve months after the death of the said JOHN
DAVILE & ELIZABETH his wife or the survivor of them,
Also I give to my daughter DOROTHY IRLAM, the sum of forty
pounds to be paid at the end of twelve months after my decease
or the decease of ELIZABETH my wife or the survivor of us.
Also i give and bequeath to my daughter BARBARY WHITTAL the sum
of thirty pounds to be paid at the end of twelve months after my
decease or the decease of ELIZABETH my wife or the survivor of
us.
I give and bequeath to my daughter ELIZABETH DAVILE the sum of
fifty pounds to be paid at the end of twelve months after my
decease or the decease of ELIZABETH my wife or the survivor of
us.sum of fifty pounds to be paid equally between them share and
share alike
Also I give to my dear wife ELIZABETH DAVILE and my daughter
ELIZABETH DAVILE the sum of fifty pounds to be paid equally
divided between them share and share alike and my will and mind
is that my said wife ELIZABETH DAVILE shall have a power to
dispose of her share twenty five pounds as she shall think fit
at her death, and in case my wife ELIZABETH DAVILE shall not
have disposed of the said twenty five pounds by will at her
death then the said twenty five pounds shall be paid to my said
daughter ELIZABETH DAVILE. Lastly as to all my household goods
and the rest of my goods and chattels I give and bequeath to my
wife ELIZABETH DAVILE and my daughter ELIZABETH DAVILE jointly
between them and appoint them my executrixes
