The Will of The Reverend Ebenezer Daniel

 

In the Name of God Amen I Ebenezer Daniel now of Luton Bedfordshire but expecting soon to remove as a Missionary of the Gospel to Ceylon in the East Indies being now in a good state of bodily health and in the full possession of my reasoning faculties but knowing the uncertainty of life especially in the circumstances in which I am about to be placed do make this my last Will and Testament abrogating all others which may have been made and desiring that this may stand and be executed  ffirst of all I commend my immortal soul into the hands of the Lord Jesus Christ who has bought it with the price of his own blood with a humble yet confident hope that at the hour of death he will receive it to heaven and raise my body from the grave to the resurrection of eternal life in the next place   I make Sarah Daniel my beloved wife my sole Executrix to whom I entrust all the property which may belong to me at my death to be used by her for her own benefit and that of my children during the remaining period of her life and after her death to be divided in the following manner one half of all the property I may leave shall be equally divided between my children viz my three daughters Mary Ann Daniel   Maria Daniel and Emily Sarah Daniel  should they survive their mother and if any of them should die before their mother those who may remain in this world shall have the above moiety equally divided between them or of one only shall remain she shall be entitled to the whole of it and in the event of my haveing another child or children subsequently to the date of this will he she or they shall equally share in it in a similar part or parts with those who are now living, the remaining half of my property my wife Sarah Daniel shall dispose of according to her pleasure or in the event of her dying intestate my children who shall survive shall share it in the same manner and proportion as they will do the other part and in the event of any property falling to me after my death whether by bequest or inheritance or any other way it is my will that it be disposed of in the same manner and proportion as above specified in token of this being my last will and my desire it should be executed according to its literal meaning I hereby subscribe my name this thirteenth day of March in the year of our Lord eighteen hundred and thirty

Codicil to the annexed will I Ebenezer Daniel do hereby confirm all the parts of the above will as far as the parties who remain in life can share in them but as my children have returned from Colombo in Ceylon where I am now situated and God has by death taken away my beloved wife by death I hereby appoint my eldest daughter Mary Ann Daniel my sole Executrix for that part of my property which is in England and Revd Henric Siers and Mr Louis ....man my executors to any part of my property I may have in Ceylon directing them to turn it into money in the way that may be most advantageous soon after my death and remit the same to my Executrix in England who shall divide it in connection with my property there into equal shares with herself and two sisters with the exception that she as my first born shall have fifty pounds more than either of the others if my death should occur before my youngest  child Emily Sarah Daniel come to age or if after she have come to age her mental alienation should remain on her I appoint the above mentioned Mary Ann Daniel Mr Samuel Daniel and Mr ffrancis Harrison of Luton in Bedfordshire her guardians till she arrive at age or till her mental aff...ion be removed in order that they may manage her share of the property for her advantage In token of which I this fifth day of June 1837 set my hand and seal    Ebenezer Daniel  Colombo Ceylon  signed sealed and delivered in the presence of  J Milder  J W Nadan  Thos Garnier

 

Proved at London with a Codicil 11th March 1845 before the Worshipful John Danberry Doctor of Laws and Surrogate by the oath of Mary Ann Tranter widow formerly Mary Ann Daniel spinster the eldest daughter the sole executrix for England named in the said Codicil to whom Admon was granted having been first sworn duly to administer.
