This is the Last Will and Testament of me JOHN
COTTINGHAM of Stockton upon Tees in County of Durham gentleman made
14 February 1778
I give and devise to my mother ELIZABETH
COTTINGHAM all my personal estate whatsoever subject only to the
payment of my debts and funeral expences. I give devise and confirm
unto my said mother ... all my messuages lands and tenements and
hereditaments in Stockton or elsewhere in County Durham and I give
and devise to my cousins Mr JOHN FOSS of Catterick in the County of
York and JOHN THEAKSTON of Hurworth in the County of Durham clerk
all my messuages dwelling houses lands and hereditaments within the
township of Tunstall and West Appleton in the County of York To Hold
to JOHN FOSS and JOHN THEAKSTON their heirs and assigns.... for the
term of 200 years from my decease .... Upon Trust ... the premises
in Tunstall and West Appleton to my mother during her natural life
... and in case my said mother and my Aunt Mrs MARY COTTINGHAM shall
be both living at my decease [the premises were subject to a life
interest of Aunt Mary Cottingham] ... an annuity of £40 to my mother
during the joint lives of my said mother and aunt ..... [when the
mother and aunt die] ... I give and devise all my said messuages
lands tenements and hereditaments in Stockton and elswhere in the
County of Durham and in Tunstall and West Appleton and elswhere in
the County of York unto my brother RALPH COTTINGHAM ... for ever ...
and if my said brother shall not be living at my decease ... unto
LEONARD ROBINSON of Stockton, merchant son of my late cousin LEONARD
ROBINSON of the same place merchant deceased .... with the payment
of £50 to my cousin ELIZABETH WRIGHT the wife of BAINES WRIGHT and
my cousins JOHN FOSS and JOHN THEAKSTON, and my cousins MARGARET
CALVERT, DOROTHY ELLISON, JANE CHARLTON, MARY LONSDALE, MARMADUKE
CALVERT, ANN POWEL, BARBARA CLARKSON, MARGARET THEAKSTON, MARTHA
THEAKSTON, DOROTHY THEAKSTON and HELEN THEAKSTON respectively £50 a
piece ... and also with the payment unto MARY the daughter of my
late cousin ELIZABETH SHAFTO deceased £50 .... my cousin JANE wife
of DARCY FOWLER late of Stockton ... the interest of a sum ... and
after the decease of JANE FOWLER to JANE MARIA FOWLER daughter of
JANE FOWLER....
I direct that my Pew in the Parish Church of
Stockton shall go along with my dwelling house in Stockton and I
hereby appoint my mother ELIZABETH COTTINGHAM sole executive of this
my Last Will and Testament revoking all former wills by me at any
time heretofore made In Witness Whereof I the said JOHN COTTINGHAM
have to this will set my hand and seal
