In the Name of God Amen I Roger Cossins of Crewkerne in the County of Somerset gentleman being of sund and disposing mind memory and understanding (thanks be to God) do make and publish this my last Will and Testament in manner following (that is to say) I give devise and bequeath unto my sons John Cossins Arthur Cossins and Bartholomew Gidley the now Husband of my daughter Betty Upton their Heirs Exors Admors and Assigns All that my new erected Messuage or Dwellinghouse lately Pestors situate and being in Crewkerne aforesaid with the Garden and Appurts thereto belonging together with all and every other my real Estates and Leasehold Estates and all other my Personal Estate and Effects whatsoever and wheresoever To hold the same unto and to the use of them the said John Cossins Arthur Cossins and Bartholomew Gidley their Heirs Exors Admors and Assigns upon trust that they do within one Year next after my decease sell and dispose of Erected Messuage or Dwellinghouse with the Garden and Appurts thereunto belonging and also my said other real Estates Leasehold Estates and Personal Estate and Effects by Public Auction for the most Money that can be held or gotten for the same And I do hereby declare that the Receipt or Receipts of my said Trustees shall be a god and sufficient discharge and discharges for so much of the Purchase Money as shall be therein expressed or acknowledged to be received and that such Purchaser or Purchasers his her or their Heirs Exors Admors and Assigns shall not afterwards be obliged to see to the application of such Purchase Money or any part thereof or be answerable or accountable for any Loss Misapplication or Nonapplication thereof and I do hereby will and direct that the Money to arise from such Sale or Sales as aforesaid after deducting and paying thereout all my Just Debts and ffuneral Expences together with the Costs and Charges of Proving this my Will the Expences of such Sale or Sales and all Costs Charges Damages and Expences which they my said Trustees their Heirs Exors Admors and Assigns shall or may suffer sustain expend disburse be at or be put unto in or about the Exon or management of all or any of the Trusts hereby in them reposed to divide pay divide and dispose of in manner following (that is to say) as to three fill eighth parts or shares thereof (the whole into eight parts or shares to be divided) to my son John Cossins his Exors Admors or Assigns to and for his or their own proper use and benefit and as to the other full eighth parts or shares thereof (the whole into eight parts or shares to be divided) to my Son Arthur Cossins his Exors Admors or Assigns to and for his or their own proper use and benefit And as for and concerning the remaining two full eighth parts or shares thereof (the whole into eight parts or shares to be divided) to the said Bartholomew Gidley and Betty Upton his Wife their Exors Admors or Assigns to and for their own proper use and benefit and to for or upon no other use trust interest or purpose whatsoever And I do hereby declare that the six Eighths of the Money to arise from such Sale or Sales as aforesaid and hereinbefore directed to be paid to my said Sons John and Arthur or any part thereof is not intended for the use of my Son William Cossins his Exors Admors or Assigns And my Will also is that my said Trustees shall be charged and chargeable only with and for such Monies as he or they shall respectively actually receive by virtue of the Trusts hereby in them reposed and shall not be answerable or accountable for any Loss which may happen to the aforesaid Trust Premises except the same shall happen or arise by or through their own wilful default respectively and that the one of them shall not be answerable Or accountable for the other of them or for the Acts Deeds Defaults Receipts or Disbursements of the other of them And I do hereby nominate constitute and appoint the said John Cossins Arthur Cossins and Bartholomew Gidley Exors of this my Will hereby revoking all former and other Wills by me at any time heretofore made declaring this and this only to be my last Will and Testament In Witness whereof I have to the first Sheet of this my Will contained in two Sheets of paper annexed together set my hand and to this last Sheet thereof my hand and Seal this 22nd day of November in the Year of our Lord 1802 Ro: Cossins
