The Will of William Constable

 

In the Name of God Amen I William Constable of Capell in the County of Surry Yeoman being in good Health of Body and of sound and disposing Mind Memory and Understanding thanks be to Almighty God for the same do make and declare this my last Will and Testament in Writing hereby revoking and making Void all other Wills whatsoever by me at any time heretofore made ffirst and Principally I commend my Soul into the Hands of Almighty God hoping and Assuredly believing in and through the Merits of Jesus Christ my blessed Saviour and Redeemer to obtain Pardon and forgiveness of all my Sins and everlasting Life and my Body I commit to the Earth to be decently buried in Christian Burial art the Discretion of my Executrix herein after named And as to my Worldly Estate ffirst I give and devise unto my Son Michael Constable and his Heirs All that Customary or Copyhold Messuage or Tenement and Orchard with the Appurtenances heretofore parcel of Duncroft lying in Capell aforesaid holden of the Mannor of Dorking And also all that Customary or Copyhold Messuage Tenement and ffarm with the Barns Outhouses Edifices and several ffields Closes or parcels of Land to the same belonging commonly called or known by the name or names of Bromhalls and containing by estimation ffifty acres more or less situate lying and being in Capell aforesaid with all and singular their Appurtenances and holden also of the said Mannor of Dorking To have and to hold the said Several Messuages or Tenements Orchard Barns Outhouses Edifices ffields Closes or Parcells of Land and Premises with their and every of their Appurtenances unto my said Son Michael Constable and his Heirs and Assigns for ever Subject nevertheless to the ffree Bench of my loving Wife Mary Constable of and in all and singular the said Several Messuages or Tenements Orchard Barns Outhouses Edifices ffields Closes or parcels of Land and Premises to which she will be entitled by the Custom of the said Mannor of Dorking Also I give and bequeath unto my said Son Michael Constable his Executors Administrators and Assigns all my ready Monies Houshold Goods Stock Cattle Chattles and all other my Personal Estate whatsoever (after all my just Debts and ffuneral Expences shall be fully Paid and satisfied thereout by my Executrix herein after named) Except only the Sum of Twenty Pounds which I do hereby give and bequeath unto my said Loving Wife Mary Constable or in Lieu thereof such part of my said Houshold Goods to the Value of Twenty Pounds as she shall like best Provided always nevertheless that if my said son Michael Constable shall happen to die before he shall have attained his Age of Twenty One Years without Issue of his Body lawfully begotten Then (after the death of my said Loving Wife Mary or fforfeiture of he ffree Bench as aforesaid) I do give devise and bequeath all and singular the said Messuage or Tenements Orchard Barns Outhouses Edifices ffields Closes or parcels of Land and Premises with their and every of their Appurtenances unto my Kinsman Matthew Spencer of Warnham in the County of Sussex Yeoman and John Agate of Broadbridge Heath in the Parish of Warnham aforesaid Yeoman their Heirs Executors Admors and Assigns And also all my Personal Estate aforesaid In Trust to be sold for the best price and prices that can be gotten for the same and out of the Money arising therefrom in the ffirst place to pay unto my servant Thomas Steadman the Sum of Twenty Pounds and the Remainder thereof to pay and divide unto such persons and in such proportions as are herein after mentioned (that is to say) One Sixth Part thereof unto my Kinsman Michael Constable of Dorking aforesaid Gentleman One other Sixth Part thereof unto my Kinsman John Constable of Dorking aforesaid Malster One other Sixth part thereof unto my kinsman Joseph Constable of Dorking aforesaid Yeoman  One other Sixth Part thereof unto Nicholas Constable and Edward Constable Sons of my late Uncle Edmund Constable late of Dorking aforesaid Blacksmith deceased to be equally divided between them One other Sixth Part thereof unto the Two Children of my late Kinsman Benjamin Constable late of Dorking aforesaid Blacksmith deceased to be equally divided between them  and One other sixth part thereof unto John Constable and Joseph Constable Sons of my late uncle Joseph Constable late of Ockley in the said County of Surry Shopkeeper deceased to be equally divided between them share and share alike And I do hereby nominate constitute and appoint my said Dear and loving Wife Mary Constable Sole Executrix of this my last Will and Testament contained in Two Sheets of Paper set my hand and Seal at the Bottom of each Sheet and my Seal at the Top hereof the Twenty Eighth day of December in the Thirty second Year of the Reign of our Sovereign Lord George the Second by the Grace of God of Great Britain ffrance and Ireland King Defender of the ffaith and so forth And in the Year of our Lord One thousand seven hundred and ffifty Eight   William Constable
