The Will of Thomas Collard
In the Name of God Amen, I Thomas Collard of the Parish of Westbury in the County of Somerset Yeoman (being in good health, and of sound disposing Mind Memory and Understanding) and considering the uncertainty of this present life do make publish and declare this to be my last Will and Testament in manner and form following (that is to say) I order and direct that all my just debts, funeral and testamentary expenses be paid and discharged by Trustees hereinafter named, as soon as conveniently after my decease and subject thereto, I dispose of my real and personal Estate in the following manner - I give and bequeath unto, and to the use of my Friend Mathew Masters of Westbury aforesaid Yeoman, and my son James Collard of Yarley in the Parish of Wookey, Yeoman and the survivor of them and his Executors or Administrators all that my Leasehold Dwelling house, garden and premises situate at Westbury aforesaid Also my live and dead farming stock implements in husbandry household goods and chattels, money and security for money wheresoever and whatsoever I may be possessed of at my decease upon Trust for my wife Frances Collard without impeachment of waste And as soon after my decease as my said Trustees or Trustee think proper to sell all the said farming stockand implements in husbandry by public auction and I desire that my Trustees do allow my said wife free liberty to select from my furniture or household goods sufficient to furnish two rooms (namely) one room on the ground floor and a bedroom on the second story And I also direct and desire my said Trustees to pay over to my aforesaid wife twenty pounds part of the proceeds of such sale or auction for her use and benefit And to place the remainder of the proceeds of such sale or auction out at interest on proper securiety and to pay the amount of such interest over to my said wife Frances Collard yearly for her use and benefit during her Widowhood and also to allow my said wife Frances to occupy the said dwelling house, garden and premises or to receive the rents and profits therefrom during her widowhood And from and after her decease to sell the same dwelling house, garden and premises by public auction or private contract, Under such conditions or restrictions as to title as they the Trustees may deem meet and to facilitate such sale that the Trustees or Trustee for the time being of this my will do make and execute all necessary conveyances and assurances to the purchaser of purchasers and give a proper receipt for the purchase monies which shall effectually discharge the Purchaser or Purchasers from seeing to its application and after deducting the expenses attending such sales and conversion of the estate into money to pay over the residue of the said purchase monies unto and equally between my sons Charles Collard Cornelius Collard, James Collard and Thomas Collard And my daughters Joanna Stott and Frances Spencer or their issue to whom I give and bequeath as tenants in common In witness whereof I the said Thomas Collard the Testator have to this my last Will and Testament set my hand and seal this
