The Will of Thomas Colbatch

 

This is the last Will and Testament of me Thomas Colbatch of Leek in the County of Stafford Silk Manufacturer I direct my just debts and funeral and testamentary expences be paid by my Executors out of my Personal Estate I give devise all and singular my real and Personal Estate whatsoever and wheresoever unto and to the use of my Brother John Colbatch of Brighton in the County of Sussex Esquire his heirs executors administrators and assigns upon trust to call in all monies due to me and by sale to convert such part of my estate and effects as are in their nature saleable into money and to stand possessed of such monies and of the proceeds of such sale or sales and also of all the rents which may from time to time in respect of my leasehold property or other wise upon trust to invest the same upon good and sufficient security and to receive the interest dividends and annual produce thereof and from time to time pay one half part thereof unto my Brother William Colbatch of London Silk Manufacturer during his natural life and the other half part thereof unto my Sister Elizabeth the Wife of William Onions of Shrewsbury Surgeon for her own sole and separate use during her natural life and her receipt alone to be a sufficient discharge for the same, notwithstanding her coverture and the same shall not be liable to the debts or control of her present or any future husband and from and after the decease of the said William Colbatch and Elizabeth Onions (whichsoever shall die first) the annual proceeds of the whole of my property shall go to the survivor for the term of his or her natural life and if the said Elizabeth Onions should be the survivor for her sole and separate use as aforesaid and from and after the decease of such survivor I direct my said trustee his executors and administrators to pay and divide the whole of the said principal trust monies & premises unto & equally amongst all and every the child and children who shall be then living of the said Elizabeth Onions and the issue of such of them as shall be then dead such issue taking his or their parents share only and I declare that the shares of the children of the said Eliz Onions shall be vested interests and the annual proceeds shall be payable at the decease of the survivor of them the sd William Colbatch and Elizabeth Onions but the principal shall not be payable until they severally attain twenty one and I hereby appoint the said John Colbatch Executor and I declare that the receipt of the said John Colbatch shall be a good discharge for all sums of money which he may receive under the trusts of this my will and he shall not be answerable for any loss except the same shall happen through his wilful neglect or default to my brother John….what may be of more value than money I leave him the blessing of a dying Brother with a full remembrance of all his earthly kindness and the prayers of a poor helpless Sinner through the redeemer will avail then does he sincerely pray that he may receive all comfort on this side of the grave and on the other everlasting peace and hereby revoking all former and other will and wills & other testamentary dispositions at any time heretofore by me made and I declare this to be my last In Witness whereof I have hereunto set my hand this fourteenth day of August one thousand eight hundred and forty three Thos Colbatch
