The Will of Brume Cockram

 

This is the last Will and Testamt of me Brune Cockram of Sandwich in the Isle of Purbeck and County of Dorset Gent made the three and twentieth day of November in the year of our Lord 1723 impris I revoke all former wills by me heretofore made and my will and desire is that all my debts funeral charges and expenses be first paid and satisfied Item I give and devise unto John Cockram the elder of Newton in the said parish of Sandwich gent Lewis Cockram of Newton aforesd gent son and heire apparent of the said John Cockram Thomas Pushman of Sandwich aforesd Marbler Richard Talbute of Sandwich aforesd Miller Henry Vye of Sandwich Marbler Samuel Serrel of Sandwich aforesd Marbler John Hayward of Sandwich aforesd Marbler and James Keates of Langton in the said Isle of Purbeck and county of Dorset Marbler and their heirs for ever all that my messuage or tenement with the orchard garden and appurtenences thereunto belonging situate lying and being in the said parish of Sandwich commonly called or knowne by the name of Kerridges Tenement and now in the tenure or occupation of William Spracke or his assigns upon the Sewall Trusts and to the uses intents and purposes and subject to the provisoes and conditions concerning the same hereinafter limited expressed and declared (that is to say that they the said Trustees or the survivor of them shall stand and be possessed and seized of the rents issues and profits of the said messuage or tenement and premises with the appurtines for and towards the maintenance and keeping of a good able and learned schoolmaster for the teaching and instructing of fifteen such poor children of and belonging to the said parish of Sandwich as the said Trustees or the major part of them shall approve of in the arts or sciences of writing arithmeticke and navigation and my will and desire is that the said Trustees or the major part of them shall have the power of choosing and electing such person for a schoolmaster and at any time afterwards after such person so choosen and elected by the said Trustees or the major part of them as aforesd they the sd Trustees or the major part of them may on their proving lawful cause of negligence or ignorance in any such schoolmaster so choosen elected as aforesd to put out discharge and dismiss such schoolmaster and shall and will choose and elect any other person for a schoolmaster in his or their roome and stead as they the sd Trustees or the major part of them shall thinke proper and convenient and also my will and desire is that such schoolmaster so to be elected as aforesd shall be obligd to live and reside in the dwellinghouse of and belonging to the said messuage or tenement and to keep the said messuage or dwellinghouse and the walls and fences of the orchard and garden thereunto belonging in good and sufficient repaire and shall not commit any waste or spoile on the premises and further my will and desire is that the said Trustees or the major part of them shall and will yearly pay unto my brother John Cockram his heirs and assins for ever the sum of two shillings of lawfull money of Great Britain out of the rents issues and profits of the said messuage or tenement and premises with appurtines herein before mentioned to be given and devised to them (on Easter Munday and on non-payment thereof that it shall and may be lawfull to and for my brother John Cockram and his heirs and assns to dis… for the same on the sd premises or any parte thereof Item I give and devise unto the sd John Cockram the elder Lewis Cockram Thos Pushman Richd Talbute Henry Vye Samuell Serrell John Hayward and James Keates their heirs and assns for ever one annuity or yearly rent charge of ten pounds of lawfull money of Great Britain free and clear of and from all manner of Parliamentary taxes and other rates and impositions whatsoever to be issuing arising and going out of all and singular my messuages or tenements lands hereditamts and premises with the appurtinies thereunto belonging or in any wise appertaining situate lying and being within the Borough of Corfe Castle in the Isle of Purbeck and County of Dorset now in the several Tenures or occupations of James Thomson John Benfield and Ralph Scriven or their several assignes to be paid at two half yearly payments to and for the only use benefit and behoofe of such schoolmaster of the said Parish of Sandwich for the time being or shall be so legally choosen and elected by my sd Trustees or the major part of them upon the conditions hereinbefore mentioned and my further will and desire is that on the nonpayment of the sd annuity or yearly rent charge of ten pounds at two half yearly payment by even and equal portion as aforesaid that is shall and may be lawful to and for such schoolmaster for the time being to disteine for the same on the said promises or any part thereof and my further will and desire is that in case at any time hereafter one of my Trustees shall happen to dye that then and in such a case the surviving Trustees or the major part of them do and shall choose and elect another Trustee in the roome and stead of the Trustee so dying and so to keep the number of the said Trustees always full.  Item I give unto twelve poor persons settled inhabitants within the borough of Corfe Castle and not receiving any almes of the parish of Corfe Castle the sum of three pounds of lawfull money of Great Britain the persons to be nominated and appointed by my executor hereinafter named which said sum of three pounds is to be paid in twelve months after my decease to be equally divided betwixt them Item I give unto twelve poor persons settled inhabitants of the sd parish of Sandwich the sum of three pounds of lawfull money of Great Britain the persons to be nominated and appointed by my executor hereinafter named which said sum of three pounds is to be paid in twelve months after my decease to be equally divided betwixt them Item I give and bequeath to my brother Thos Cockram one shilling.  Item I give and bequeath unto my brother in law John Vincent five shillings to be laid out in keeping his damp beds well aired Item I give and bequeath unto my sister Vincent one shilling.  Item I give and bequeath unto my brother in law Samuel Serrell one shilling Item I give and bequeath unto my sister Serrell one shilling Item I give and bequeath unto my brother in law Anthony Wareham the sum of ten pounds to buy him a horse particularly for his own riding but if any time hereafter made use of for the plough my will and desire is that the sd sum of ten pounds be returned back again to my said brother John Cockram to whom I give the same.  Item I give and bequeath unto my sister Anna Wareham my silver tobacco box and my silver bottle screw marked with a Coat of Armes.  Item I give and bequeath unto my neece Elizabeth Wareham my silver snuff box  marked with a cipher and also the sum of one hundred pounds of lawful money of Great Britain to be pd her at the day of her marriage or at her age of one and twenty years which shall first happen  with its lawful interest from the time of my decease and in case the said Eliz Warham shall happen to dye before she is married or before she shall attain to the age of one and twenty years then my will and desire is that the profits and interest of the said sum of one hundred pounds be paid unto my said brother in law Samuel Serrell in trust to and for the only benefit use and behoof of my said sister Anna Wareham for and during the term of her natural life and from and after her decease I give and bequeath the sd sum of one hundred pounds unto my said brother John Cockram Item I give and bequeath unto Sarah Smith Spinster the use of all my table linnen and also the use of all my household goods and beds now being at my house in Norbrooke to be carefully taken care of by her for and during the term of her natural life excepting out of the sd goods at Norbrooke my silver plate guns swords and pistols and further my will and desire is that the said Sarah Smith shall have the liberty of burning all my fuel that shall happen to be at Norbrooke at the time of my decease and also the use of one silver spoon marked with the letters BC and dated 1671 for and during the terme of her natural life and after her decease I give and bequeath the said silver spoon unto my brother John Cockram and also my further will and desire is that the said Sarah Smith shall have the liberty of cutting one thousand and half of turves yearly out of Ower Heath and the Carriage thereof be yearly allowed and given her by my Extor hereinafter named for and during the term of her natural life to her dwellinghouse or place of habitation at Norbrooke in the said parish of Sandwich only and also that my Extor hereinafter named do and shall well and truly pay at every six months ende unto the said Sarah Smith the sum of twenty shillings of lawfull money of Great Britain for so long time as she shall dwell and inhabit in the sd parish of Sandwich I also further give and bequeath unto the sd Sarah Smith my cane with the amber head all my under stockings and piece of Bay Holland containing about six eles and also one piece of Garlicke Holland containing between nine or ten eles or thereabouts and also the sum of four pounds of lawfull money of Great Britain to buy her a mourning suite and to be pd her by my extor hereinafter named on the day of my decease and the rest of my goods and things to be delivered by my sd extor hereinafter named in three weeks after my decease.  Item I further will and devise that after the decease of the said Sarah Smith all my household goods beds and table linnen hereinbefore  given to the sd Sarah Smith shall be and remain and I do give the same unto my sd neece Eliz Warham I also further give and bequeath unto my sd neece Eliz Warham my two silver spoons marked with the letters M H and B C item I give and bequeath unto Jonathan Cole Merchnt Tayler my second best suit of cloaths at Bucknowle and my light plush breeches my sticke with the glassen head three of my dowlas night shirts my blue great coate and my best second hat and my further will and desire is that the sd Jonathan Cole may have the liberty of three years time after my decease for the payment of his money due to me on bonds unto my executors hereinafter named and also I further give and bequeath unto the said Jonathan Cole the sum of five pounds of lawfull money of Great Britain Item I give and bequeath unto Willm Cole of Alwell my light coloured suite of cloaths and my black plush breeches three of my dowlas night shirts and also the sum of five pounds of lawful money of Great Britain Item I give and bequeath unto the sd Jonathan Cole and Wm Cole all my musling cravats to be equally divided bewixt them Except four of my best murling cravetts which I give and bequeath unto my brother John Cockram.  Item I give and devise all and singular the hereinbefore mentioned messuages or tenemts lands hereditaments and premises with the appurtines thereunto belonging or in any wise appertaining situate lying and being within the Borough of Corfe Castle aforesd and chargeable with the sd yearly rent charge of ten pounds forever unto my sd brother John Cockram his heirs and assigns for ever.  Item I give and devise unto my said brother John Cockram and to his heirs and assins for ever all those my lands messuages or tenements and hereditments whatsoever with their appurtines thereunto belonging or any wise appertaining situate lying and being at Ower in the parish of Corfe Castle and Studland in the Isle of Purbeck and County of Dorset and all other my lands and hereditaments whatsoever situate lying and being in the sd Isle of Purbeck and County of Dorset and I do allow order and appointe the sum of fifty pounds of lawful money of Great Britain to be laid out and expended by my extors hereafter named in my funeral expences and my will and desire is that my body be laid in a double coffin and carried in a hearse drawne with four horses to the parish church of Sandwich and then borne and carried to my grave by six bearers and my grave to be digged six foot deep close by my late mother Mary Cockram widow deceased in the parish church of sandwich and also that my extor hereinafter named do cause a good toombe stone to be laid on my grave and my further desire is that Mr Manning or Mr Russell may preach my funeral sermon and that seven and twenty shillings be pd for preaching the same and my further will and desire is that silk mourning hat bands be given at my funeral and that the said Jonathan Cole and Wm Cole to have one each Item all the rest residue and remainder of all and singular my goods and chattels rights and credits not hereinbefore given and bequeathed I give and bequeath unto my said brother John Cockram whom I nominate make and ordain full and sole executor of this my last will and testament and do make and ordain the said Jonathan Cole and William Cole my friends in trust to see that this my last will and testament duly performed and do also order and appoint that they shall be satisfied by and paid in or about the execution of their trust reposed in them by this my last Will and Testament.
