The Will of Willm Clements deceased
This Will was proved at Sarum on the 2nd
June 1804 Before the Revd Edward Moore Clk M.A. lawful Surrogate
of the Reverend and Worshipful William Douglas Clk M.A.
Archdeacon of the Archdeaconry of Wilts and by him Adcon of the
Goods& Chtles of the deceased soforth was granted to Joseph
Clements the lawful Nephew of the deceased and the sole Exor
within named being first duly sworn of the truth of the said
Will to perform the same and pay the Debts and Legacies of the
deceased &c and to make a true Inventory and render a just
Account when required & saving the Rights of all persons.

Reverend John Rees and Hazeland Clerks Greeting We do hereby
authorize impower and give Commission unto You (in whom we
perfectly confide) jointly and severally to administer the Oath
under written in manner and form there set forth to Joseph
Clements Gentleman the Sole Executor named in the last Will and
Testament of William Clements late of Beckhampton in the parish
of Avebury in the County of Wilts and our said Archdeaconry of
Wilts deceased Requiring You duly to return these Presents to us
or our lawful Surrogate or other competent Judge in this Behalf
withte said Original Will annexed and a Certificate under your
Hands or the Hand of either of You who shall duly execute this
our Commission Testifying what you or either of You shall have
done in the Premises by virtue of these Presents on or before
the last day of April next ensuing otherwise the same to be void
and of non effect

The Form of the Oath to be administred to
the said Joseph Clements laying his Right hand on the Holy
Gospels is as follows:
You swear that the paper Writing hereto
Doth in it contain the true Original last Will and Testament of
William Clements late of Beckhampton in the parish of Avebury
deceased as far as you know or believe that you are the sole
Executor therein named
That You will duly administer the same and
pay his Debts and Legacies as far as his Goods Chattles and
Credit will extend and the Law bind Yo; and that you will make,
or cause to be made, a true and perfect Inventory of all and
singular the Goods Chattles and Credits of the said deceased
which since his Death have and shall come to your Hands
Possession or Knowledge, and exhibit the same into the Registry
of the Archdeacon of Wills, and pass a just and true account of
your Executorship when thereto lawfully required, and that the
Goods Chattles and Credits of the said deceased do not amount in
value to the Sum of Three Hundred Pounds So help You God /-/

This Commission was duly executed at
Trowbridge Wilts on the Sixth Day of March 1804 and the Oath
above written was adminstred to the said Joseph Clements and by
him duly taken, before me,

This is the last Will and Testament of Me
William Clements of Beckhampton in the Parish of Avebury in the
County of Wilts Yeoman I desire all my just Debts Funeral
Expences and Charges of proving this my Will be first fully paid
and satisfied I Give and Devise to my Nephew Joseph Clements of
Trowbridge in the said County of Wilts All Those my Freehold
Lands Tenements and Hereditaments situate at Broad Town in the
Parish of Glyff Pypard in the said County of Wilts subject and
chargeable with the several pecuniary Legacies herein after
particularly mentioned To Hold to him the said Joseph Clements
(subject to as aforesaid) his Heirs and Assigns for ever I Give
and Devise to my Niece Rachael Dixon of Avebury aforesaid and
her Assigns All that Messuage or Dwelling House together with
the Land and Premises thereunto belonging now in her occupation
for and during the Term of her natural Life and from and
immediately after her Decease I Give and Devise the same to her
son Matthew Dixon to Hold to him the said Matthew Dixon and his
Heirs and Assigns for ever I Give and Bequeath unto William
Jefferies of Beckhampton aforesaid Yeoman the Sum of Three
hundred and five Pounds of lawful British Money to for and upon
the several Uses Ends Intents and Purposes following that is to
say Upon Trust that he the said William Jefferies his Executors
or Administrators and the Survivor or Survivors of them do and
shall as soon as my be after my Decease lay out and invest the
said sum of Three Hundred and five pounds in some Parliamentary
or Government security and pay the Interest and Dividends
thereof as they shall respectively become due for and towards
the Maintenance of my Niece Rachael Dixon during the Term of her
natural Life by equal half yearly portions the first Payment
thereof to be made within six Months after my Decease and her
receipt along notwithstanding her Coverture shall be to my said
Trustee his sufficient Discharge and the same shall not be
liable to the Debts Controul or Engagements of her Husband And
from and immediately after the Decease of my said Niece Rachael
Dixon Upon Trust that my said Trustee his Executors
Administrators and the Survivors or Survivor of them do and

shall pay and divide the Interest of the
said Trust Monies or such much and such part thereof as he or
they shall think reasonable for and towards the Maintenance and
Education of all and every such Child and Children Sons and
Daughters of my said Niece Rachael Dixon during their respective
Minorities and from and immediately after such Child or Children
attaining his her or their Age or ages of twenty one years
Then upon Trust to divide the said Trust
Monies and all accumulated interest thereon equally amongst them
share and share alike Provided always that if any such Child or
Children of the said Rachael Dixon shall die before he she or
they attain his her or their Age or Ages of twenty one years
respectively then the Share or Shares of him her or them so
dying shall from Time to Time go accrue and belong to the
Survivor or Survivors of them and be paid assigned or
transferred (if more than one) equally share and share alike, at
such Time or Times in the same Manner to such surviving Child or
Children then in being as is before mentioned touching his her
or their original Share or Shares I Give and Bequeath to my
Nephew Stephen Clements son of my late Brother Robert Clements
the sum of Ten Pounds of lawful British Money to be paid him
within one year next after my Decease I also Give and Bequeath
unto the said William Jefferies the sum of One Hundred Pounds to
for and upon the several Uses Ends Intents and Purposes
following, that is to say, Upon Trust that he the said William
Jefferies his Executors or Administrators and the Survivors or
survivor of them do and shall as soon as may be after my Decease
lay out and invest the said Sum of one hundred pounds in some
Parliamentary or Government Security and pay and apply the
Interest and Dividends thereof as they shall respectively become
due for and towards the Maintenance and Education of All and
every Child and Children of my late Niece Ann Alexander Daughter
of my late Brother Robert Clements during their respective
Minorities And from and immediately after such Child or Children
attaining his or their Age or Ages of twenty one Years Then Upon
Trust to divide the said Trust Monies and all accumulated
Interest equally amongst them share and share alike Provided
always That if any such Child or Children of the said Ann
Alexander shall die before he she or they shall attain his her

their ages of twenty one years
respectively then the share or shares of him her of them so
dying (or so much thereof as shall not have been assigned or
disposed of and applied to his her or their Preferment
Advancement or Benefit as herein after mentioned) shall from
time to time go accrue and belong to the survivor or survivors
of them and be paid assigned or transferred, if more than one,
equally share and share alike at such Time or Times and in the
same Manner to such surviving Child and Children then in being
as is before mentioned touching his her or their original share
or shares I also Give and Bequeath to my Nephew Stephen Clements
Son of my late Brother Joseph Clements the Sum of Forty Pounds
of lawful British Money Ten pounds whereof I hereby direct shall
be paid him within six Months after my Decease but in case the
said Stephen Clements should die during my
Lifetime Then my Will is that the said Legacy of Forty Pounds
should go to and be equally divided by and between all and every
Child and Children of the said Stephen Clements share and share
alike I also Give and Bequeath to Mary Clements and Sarah
Clements Daughters of my Brother Joseph Clements the Sum of
Thirty Pounds each of lawful British Money I also Give and
Bequeath to the two Children of my late Nephew George Clements
the sum of Ten Pounds a piece of lawful British Money I also
Give and Bequeath unto George Clements, Robert Clements, and
John Clements, Sons of my late Nephew Robert Clements the Sum of
Five pounds a piece of like British Money I Give and Bequeath to
Elizabeth Clements Daughter of my late Nephew James Clements Ten
pounds of like British Money I also Give and Bequeath to Sarah
Clements the Widow of my late Brother Joseph Clements the Sum of
Eighty Pounds of like lawful Money to be paid to her within
three Months after my Decease But if the said Sarah Clements
should die in my Lifetime then my Will is that the said sum of
Eighty Pounds be equally divided between all and every the Child
or Children of her the said Sarah Clements share and share alike
I also Give and Bequeath to Thomas Clements son of my late
Nephew Thomas Clements Twenty Pounds of like British Money to be
paid to him when he shall attain the age of twenty one years I
also Give and Bequeath to Stephen Clements son of my late
Brother Joseph

Clements my Wearing Apparel of every sort
or kind I Give to my Niece Phebe Chapman my Bedstead together
with the Bed and all the Furniture thereunto belonging and also
two Chair Bottom Covers I also give to the said Phebe Chapman my
silver Pepper Castor I Give and Bequeath to my Nephew William
Chapman my Silver Pint Cup And as for and concerning all the
Rest Residue of my Personal Estate whatsoever and wheresoever
not hereinbefore disposed of I Give and Bequeath the same unto
my said Nephew Joseph Clements of Trowbridge aforesaid whom I do
hereby nominate Constitute and appoint Sole Executor of this my
Will And it is my Will that my said Trustee the said William
Jefferies his Executors Administrators and the Survivors or
Survivor of him or them shall be wholly indemnified in the
Execution of the Trusts hereby in them reposed and shall and may
reimburse to himself and themselves by and out of the Monies and
Effects all Costs and Expences attending the Execution of the
Trusts hereby in him or them respectively reposed And that he my
said Trustee shall not be answerable or accountable for any
Monies or Effects other than what he or they shall actually
receive or for any Losses whatsoever unless occasioned by his or
their wilful Default or Neglect And Lastly I do hereby revoke
all former and other Wills by me at any time heretofore made and
do declare this and this only to be my last Will and Testament
In Witness whereof I have to this my said last Will and
Testament contained in four sheets of Paper to the three first
sheets thereof set my Hand and to the fourth and last sheet my
Hand and Seal this Fourth day of April in the Forty second Year
of the Reign of His Majesty King George the Third And in the
Year of our Lord one thousand eight hundred and two
Signed, Sealed, Published, and Declared,
by
the within named Testator as and for his
last Will and Testament, In the Presence
of Us who in his Presence, at his request
and in the Presence of each other have
subscribed our Names as Witnesses
