The Will of Hugh Clark

 

In the Name of God Amen. I HUGH CLARK of Spalding in the County of Lincoln Gentleman though weak in body yet being of a sound and disposing mind memory and understanding (Thanks be to Almighty god for the same) Do make and ordain this my last Will and Testament in manner and form following (that is to say) First I give and devise unto my NEPHEW HUGH HOLLAND and my NIECES FRANCES, HENRIETTA and ELIZABETH HOLLAND all and every my mefsuages houses lands tenements and hereditaments whatsoever situate lying and being in Spalding aforesaid or elsewhere, which I am entitled unto in provision expectant upon the decease of ELIZABETH CLARK my MOTHER by my late Fathers Will or otherwise To hold to these my said nephew and nieces and to the Heirs of their respective bodies lawfully to be begotten equally to be divided between them to take as Tenants in Common not Joint Tenants. But in case any or either of them my said nephew and nieces shall happen to dye under the age of twenty one years and without lawful iffue of his or her or their body or bodies then I give and devise the said mefsuages lands tenements and hereditaments with the appurtenances to the survivors or survivor of them and to their Heirs of the body and bodies of such survivor or survivors as Tenants in Common and not as Joint Tenants and for want of such iffue to the right Heirs of such survivor forever. And I do hereby will and direct all my just debts which I shall owe at the time of my decease funeral expences and charge of proving this my Will shall be paid by my Executor hereinafter named by and out of my personal estate and effects, or otherwise by the bonds and profits of my real estate and I do hereby subject and charge the same respectively with the payment thereof. And all the rest and residue of my goods chattels and personal estate whatsoever debts that are owing to me at my decease I give and bequeath to and to be equally divided amongst my said nephew and nieces share and share alike. And I do hereby nominate make constitute and appoint my brother in law John Frankland of Spalding aforesaid grocer sole Executor of this my last Will and Testament. In witnefs whereof I the said Hugh Clark the said Testator have to this my last Will and testament contained in two sheets of paper to the first part thereof set my hand and to this last sheet thereof my hand and seal this Twenty Seventh Day of December in the Year of our Lord One Thousand Seven hundred and Seventy Eight. Signed Sealed published and declared by the said Testator as and for his last Will and Testament in the presence of us, who in his presence and at his request have subscribed our hands as witnefses hereunto (all signed) Sam Lee, Joseph Hames, Nathl North

The 30 Aprill 1779 the sole Executor named in the written Will of Hugh Clarke deceased was sworn to the validity thereof and will and faithfully to execute the same. Before me J Dinham Surr.
