The Will of William Chatterton

 

In the Name of God Amen, William Chatterton (late of the New Ferry) now of Lower Bebington Pasture in the Township of Lower Bebington in the County of Chester, Gentleman, being of sound and disposing Mind Memory and Understanding do make this my last Will and Testament in manner following, first of all I will and direct that all my Just Debts Funeral expences, and the charges attending the Probate of this my last Will and Testament be paid and discharged, and whereas I am now possessed of Five several Dwelling Houses and Intitled to the Land and every appurtenance thereunto belonging , situate and being upon Bebington Pasture and the Township of Lower Bebington aforesaid , I Give and Bequeath unto my Wife Margaret Chatterton the Yearly Rents Profits and Issues of One of the best said Dwelling Houses with its appurtenances for and during her natural life for her own use and benefit . It is also my Will and desire that my said Wife shall have the liberty and be allowed and permitted to take for her own use and benefit a part of my Household Goods and Furniture which she may think convenient and proper, And as to the Yearly rents Profits and Issues of my other Four Dwelling Houses situated as aforesaid I Give and Bequeath unto my Executors hereinafter mentioned Upon Trust that they or the Survivor of them do and shall receive the Yearly Half Yearly or Quarterly Rents (for and during the natural life of my said Wife) at such time and times as they severally become due, and upon further Special Trust that they my said Executors or the survivor of them do and shall as soon as they shall receive the said Rents, divide the same Yearly Half Yearly or Quarterly amongst my surviving Children in equal portions share and share alike and in case any of my Children shall have departed this life leaving lawful Issue then and in such case I Will and direct that the Child or Children of such deceased parent or parents shall stand in the place and stead of such deceased parent or parents and shall receive the share which their deceased parent or parents would have been entitled to if living by this my last Will and Testament , And immediately after the death of my said Wife, I Will and direct that all my Five Dwelling Houses situated as aforesaid with every appurtenance thereunto severally belonging shall be by my Executor s hereinafter mentioned and whom I do hereby authorise and empower to sell and dispose of the same by Public Auction or otherwise for the most Money that can be had or gotten for them, and the proceeds therefrom arising, I Will and direct shall by my said Executors, or the Survivor of them, be equally divided amongst any surviving Children share and share alike (Except such of any Children I have in my lifetime advanced certain sums or Monies to or towards their advancement in the World which sums so advanced for such purposes as aforesaid which sums I have accounted for) shall be them be severally acknowledged and accounted for and allowed for as part of their respective share and portion they will severally be intitled to by this my last Will and Testament which shares as aforesaid I Will and direct shall become payable and be paid within the space of six months next after the decease of my said Wife but in case any of my Children shall have departed this life leaving lawful Issue then and in such case I Will and direct that the Child or Children of such deceased parent or parents shall stand in the place and stead of such deceased parent and shall be intitled to and receive the share which their deceased parent or parents would have been entitled to if living And further I do hereby authorise and empower my Executors hereinbefore mentioned or the survivor of them to Sell dispose of Assign and Convey (in such manner as Counsel shall advise) All and every part and parcel of my Freehold Dwelling Houses with the Land and every appurtenance thereunto belonging under such restrictions and directions and in such manner and at such times as are hereinbefore mentioned for such purposes And lastly I hereby nominate constitute and appoint my two sons Henry Chatterton and Thomas Chatterton Executors of this my last Will and Testament hereby revoking and making void all former and other Wills by me at any time heretofore made And do declare this to be my last Will and Testament In Witness whereof I the said William Chatterton as Testator have hereunto set my Hand and Seal this Ninth day of January in the Year of our Lord one thousand eight hundred and thirty four
