The Will of Keith Catto

 

This is the last Will and Testament of me Keith Catto of Gosport in the County of Southampton Victualler as follows

First and Principally I resign my Soul into the hands of Almighty God and my Body I Commit to the Earth to be decently buried at the discretion of my Executors and Trustees hereinafter Named and as to such Worldly Estate wherewith it has pleased God to bless me (my just Debts and Funeral Expences and the Charges attending the Proving of this my Will being first duly paid and discharged) I Give and dispose thereof in manner following (that is to say) I give devise unto William Hyslop of Gosport aforesaid house carpenter John Hyslop of the same Place House Carpenter and William Smith of Portsea in the said County of Southampton Shipwright All that Messuage or Tenement bearing the Sign of the Sun situate lying and being on the North Side of the North Street in Gosport aforesaid with the Garden behind the same and passage leading to the Shore on the North side of Gosport aforesaid and all and singular other the premises thereunto belonging now in my own Occupation also All that Messuage Tenement or Dwellinghouse situate lying and being also on the North Side of North Street aforesaid and adjoining Eastward to the said other Messuage with the Kitchen and Room over the same and all and singular other the Premises thereunto belonging which I lately purchased of Mrs Hyett And also All that Storehouse and Premises near the Shore on the said North Side of Gosport aforesaid which I also lately purchased of Mrs Hyett To hold the same with their Appurtenances unto the said William Hyslop John Hyslop and William Smith their Heirs and Assigns Upon this Special Trust and Confidence Nevertheless that They and the Survivors and Survivor of them and the Heirs and Assigns of such Survivor do and shall pay to or else well and sufficiently authorize and Empower my Daughter Jane the wife of the said William Smith to receive the Rents Issues and Profits thereof and of every part and parcel thereof for her own Use and Benefit for and during the Term of her Natural Life and from and immediately after her Decease Then upon this further Trust that They the said William Hyslop John Hyslop and William Smith and the survivors and survivor of them and the heirs and assigns of such survivor do and shall pay apply and dispose of the Rents Issues and Profits of the said Two Messuages Storehouse Hereditaments and Premises for and towards the maintenance support and Education of my Grandchildren Margaret, Jane Elizabeth Charlotte and Walter Smith and all and every other the Children of my said Daughter Jane which she shall have or She may be Enciente with at the death of her said husband and on their severally and respectively attaining the age of Twenty one years Then upon Further Trust that they the said William Hyslop, John Hyslop and William Smith or the Survivors or Survivor of them and the Heirs and Assigns of such Survivor Do and Shall by Proper Deeds of Conveyance well and truly

Grant Bargain Sell Assure Release and Convey the said two Messuages storehouse Hereditaments and Premises unto all and every the said Children their Heirs and Assigns for ever as Tenants in Common and not as joint Tenants (But in case all and every the said Children shall happen to die under the age of Twenty one Years without lawful Issue then it is my Will and Meaning that the same shall go to my right Heirs for ever. Also I Give and devise unto the said William Hyslop, John Hyslop and William Smith All that Storehouse (and Premises which I lately purchased of Mrs Brett situate and lying also near the Shore on the North Side of Gosport aforesaid and also the Quay which I lately Erected and made on the Mud Land which I lately purchased of Messrs Purkis and Compton To hold unto the said William Hyslop, John Hyslop and William Smith, their Heirs and Assigns Upon this further special Trust and Confidence Nevertheless that They and the Survivors or Survivor of them and the heirs and assigns of such Survivor Do and shall pay to or else well and sufficiently authorize and empower my Son Alexander Catto to receive the Rents Issues and Profits thereof and every Part and Parcel thereof for his own Use and Benefit for and during the Term of his Natural Life and from and immediately after his Decease Then upon this further Trust that they the said William Hyslop, John Hyslop and William Smith or the Survivors or Survivor of them and the Heirs and Assigns of such Survivor Do and shall pay apply and dispose of the Rents Issues and Profits of the said last mentioned Storehouse Quay and Premises for and towards the Maintenance Support and Education of my two Grandchildren Keith Catto and James Catto sons of the said Alexander Catto and on their severally attaining the Age of Twenty one years Then upon Further Trust that they the said William Hyslop, John Hyslop and William Smith or the Survivors or Survivor of them and the Heirs and Assigns of such Survivor Do and shall by Proper Deeds of Conveyance will and truly grant Bargain Sell Assure Release and Convey the said last mentioned Storehouse Quay and Premises unto the said Keith Catto and James Catto their Heirs and assigns for ever as Tenants in Common and not as joint Tenants. But in case the said Keith Catto and James Catto shall both happen to die under the age of Twenty one Years without lawful Issue Then it is my Will and Meaning that the same shall go to my right Heirs for ever Also I Give and Bequeath unto the said Keith Catto and James Catto the Sum of One Hundred Pounds apiece of good and lawful Money of Great Britain to be paid them on their respectively attaining the age of Twenty one years but it is my Will and Meaning and I do hereby Order and direct my said Trustees to ………………. (illegible line - missing) further maintenance Support and Education. Also I Give and bequeath unto my said Granddaughter Margaret Smith the Gold Watch

and Trinkets which were my late wife’s and also I Give and Bequeath unto my said Daughter Jane Smith All my Household Goods and Furniture Plate Linen and China and all the Rest and residue of my Monies Securities for Money and all other my Estate and Effects (not hereinbefore disposed of) of what Nature or Kind soever and wheresoever which I am now or shall be possessed or Interested in or entitled unto at the time of my Decease to and for her own Use Benefit and disposal And I do hereby Nominate and Appoint my said Daughter Jane Executrix and the said William Hyslop, John Hyslop and William Smith joint Executors and Trustees of this my will hereby revoking all former and other wills by me at any time heretofore made And I do hereby direct that my said Executrix Executors and Trustees shall not be answerable or accountable for any losses that shall or may happen to my said Estate and Effects or any Part thereof unless the same shall happen through their own Default and that they shall not be answerable the one for the others or other of them or for the acts Deeds or Receipts of the others or other of them but each of them for her and his own acts and Deeds only and I do hereby further direct and appoint that my said Executrix Executors and Trustees their Executors and Administrators shall and may deduct and reimburse herself themselves or himself by and out of may said Estate and Effects all such Costs Charges and Expences as They any or either of them shall or may expend or be Put unto for or by reason or means of the Execution or Performance of the Trusts of this my Will In witness whereof I the said Testator Keith Catto have at the bottom of the two First Sheets of this my will (the whole whereof is contained in three Sheets of Paper) subscribed my Name and to this third and last sheet subscribed my name and affixed my seal the sixteenth day of December in the Year of our Lord One thousand Eight Hundred.

 

Signed sealed published and declared by the said Testator Keith Catto as asked for his last Will and Testament in the Presence of Us who at his request and in his presence and in the presence of each other have subscribed are own Names as Witnesses thereto

On which day the within named Jane Smith William Hyslop John Hyslop and William Smith Executrix and Executors named in the within last Will and Testament of Keith Catto late of Gosport in the Diocese of Winchester and County of Southampton Victualler deceased were duly sworn that they believed the within to be the true last Will and Testament of the said Keith Catto deceased That they would pay all the Debts and Legacies of the deceased as far as the Goods would extend and the Law bind them and that they would exhibit and true full and perfect Inventory of all and every the Goods Rights and Credits of the deceased together with a joint and true Account into the Registry of the Consistory Court of the Lord Bishop of Winchester when they should be lawfully required and that the Goods Chattels and Credits of the said Deceased are under the value of three hundred pounds.
