The Will of John Carter

 

John  Carter of Healey, Masham, North Yorks.

 

This is the last will and testament of me JOHN CARTER of Healey, farmer which I make and publish this fourth day of June one thousand eight hundred and thirty eight in manner and form following.

I order and direct all my debts, funeral expenses and testamentary expenses to be paid by my executors hereinafter named out of my personal estate.

I give and devise to my sons JOHN CARTER of Healey, farmer, and ROBERT CARTER of Cowling, farmer all that freehold property and dwelling house, farm, lands, estate and hereditaments called Gyles Alley in the township of Coverham an all my other messuages, farms, lands hereditaments and real estates   whatsoever and wheresoever situate that I may be entitled to or possessed of, to hold the said hereditaments and real estate to the use of the said John Carter and Robert Carter their heirs and assigns forever as tenants in common not as joint tenants. I hereby declare and direct that any wife or wives that my said sons John Carter and Robert Carter may hereafter marry shall not be entitled to any dower out of these properties.

I give and bequeath to my wife CATHERINE an annuity or sum of thirty pounds to be paid during the term of her natural life, to be paid by my said sons, this payment to be lieu of any dower she is entitled to out of the said hereditaments. .........

I give and bequeath to my said dear wife all or as much of my household goods, furniture and implements as she thinks proper.

I give and bequeath to my daughter CATHERINE CONSTANTINE an annuity or yearly rent of twenty pounds to be paid to her by my said sons for her natural life so long as she remains the widow of the late THOMAS CONSTANTINE ..................

I give and bequeath to my grandchildren, children of my daughter Catherine Constantine, namely CATHERINE,JOHN,MARGARET,SARAH & MARY  the sum of two hundred and fifty pounds to be equally divided between them upon the decease of their mother, share and share alike, but in case any of my said grandchildren should die leaving issue then I direct that such issue shall take the share of their parent.

All residue I give and bequeath to my two sons John and Robert Carter.

I revoke all previous wills, signed on the date aforesaid

Codicil dated  14th June 1842

Revokes bequest of two hundred and fifty pounds to grandchildren and changes it to one hundred pounds apiece payable when they reach the age of twenty one.
