The Will of Elizabeth Bythewood

 

This is the last Will and Testament of me Elizabeth Bythewood of Kingston upon Thames in the County of Surry Widow ffirst I commend my Spirit unto the hands of Almighty God in the hope of pardon for all my sins and I request that my body be buried in the same grave with my late husband and that my funeral may be constituted by Mr Mason Senior of this Town but in case of his death or retirement from business then my will is that his son be employed for the purpose I direct my Executors hereinafter named to pay all my just debts funeral and testamentary charges and expences as soon as conveniently may be after my decease I give unto my nephew Charles Bythewood Stanford of Tolworth in the County of Surrey Blacksmith the sum of one hundred pounds I give to my niece Mary Woodhatch nineteen pounds nineteen shillings and to her husband John Woodhatch nineteen pounds nineteen shillings I give unto Mr George Roots one of my Executors nineteen pounds nineteen shillings I give to my grandnephews Edward Stanford Gilbert Jellians ffowers and to my grandneice Susan Stanford the sum of thirty pounds each I give to Richard Shury of Kingston aforesaid painter and Glazier ten pounds and to James Shury the younger of the same place ten pounds I give to my respected friend William Ludlow Roots of Kingston aforesaid Surgeon a ring and I also give unto Mrs William Ludlow Roots two pounds for a ring and the choice of my patchwork I give unto my niece Sarah Stanford of Tolworth aforesaid Spinster the sum of one hundred pounds and also all my rings I also give unto the said Sarah Stanford and unto the said Charles Bythewood Stanford (in equal shares) all my household goods plate linen china books and wine except such of them as have herein been otherwise disposed of I give unto the said William Ludlow Roots as Executors administrators and assigns the sum of eight hundred pounds three and a half per cent annuities further part of a larger amount of the same stock now standing in my name in the books of the Governor and Company of the Bank of England as aforesaid Upon Trust out of the interest and dividends thereof to pay unto my servant Sarah Cleveland weekly the sum of eight shillings free of legacy duty during the term of her natural life and as to for and concerning the residue of the said interest and dividends of the said sum of eight hundred pounds upon trust to make unto the said Sarah Cleveland such further weekly allowance in the case of severe illness as the said William Ludlow Roots shall think needful and also to pay and apply such other sum as he may consider necessary to keep in repair a certain cottage which I have hereinafter given to the said Sarah Cleveland for her life (such repairs to be at his sole discretion)and to pay the legacy duty on the said annuity to the said Sarah Cleveland which I have hereinbefore directed to be paid and in case of any surplus of the said interest and dividends remaining after making the several payments aforesaid then upon trust to receive and take the same to use for his own use and benefit and after the decease of the said Sarah Cleveland I give the capital of the said sum of eight hundred pounds three and a half per cent annuities unto the said William Ludlow Roots his Executors administrators and assigns I give unto my said servant Sarah Cleveland during the term of her natural life all that my freehold Cottage or tenement with the garden and appurtenances thereunto belonging and appertaining situate at Thames Ditton in the said County of Surrey and now in the occupation of Ambrose Upfold and from and after the decease of the said Sarah Cleveland I give and devise the same Cottage and garden and appurtenances unto my said nephew Charles Bythewood Stanford his heirs and assigns
I also give unto the said Sarah Cleveland my ...bed with the red flowered furniture together with one feather bed bolster and pillows one mattrass three blankets one quilt two pairs of sheets two pillow cases two towels two table cloths three bedside....one pair of drawers one mahoganey bedside stand six cottage chairs one table one small looking glass one table spoon one silver tea spoon one larger red morocco prayer book one bible and all such other articles of furniture as my executors may think necessary for the comfort and convenience of the said Sarah Cleveland I also give unto the said Sarah Cleveland all my common wearing apparel I give unto the said William Ludlow Roots his heirs and assigns all that my copyhold messuage or dwelling house wherein I now reside situate at Kingston aforesaid with the garden thereto belonging called the Pigeons Garden and the Stables and Sheds therein and also the garden on the other side of the wall adjoining Mr Looker's garden together with the leaden water....or system and all the groves in and about the said messuage and premises I also give unto the said William Ludlow Roots his heirs and assigns all that other piece or parcell of copyhold land or garden ground situate on the east side of the passage leading into Heather Street and near to my said dwelling house now in the occupation of Valor bounded on the one side by land of Mr Jennett and on the other side by land of Mr Rampard I give and bequeath unto my said niece Sarah Stanford her heirs and assigns all that my freehold messuage or tenement with the garden and appurtenances belonging situate and being at Gig Hill in the parish of Kingston aforesaid now in the occupation of the Misses Mary and Ann Collins I give to my said nephew Charles Bythewood Stanford his heirs and assigns all those four freehold cottages or tenements with the appurtenances situate at Thames Ditton in the County of Surrey and now in the several occupations of John Wheeler James Stacey John Brickwood and Thomas Pratmore I also give unto my said niece Sarah Stanford her heirs and assigns all that freehold cottage or tenement situate at Thames Ditton aforesaid and now in the occupation of Richard Love and also all that freehold cottage or tenement in Heather Street aforesaid occupied by Thomas Goult I also give all that cottage or tenement situate at Thames Ditton aforesaid now in the occupation of Thomas Hill and also all that freehold cottage in Heather Street aforesaid in the occupation of the Widow Ambridge unto my said niece Mary Woodhatch her heirs and assigns I give and bequeath unto the Vicar and Churchwardens of the said parish of Kingston for the .....being free of legacy duty the sum of two hundred pounds three and a half per cent annuities further part of a larger sum of that stock now standing in my name in the books of the Governor and Company of the Bank of England as aforesaid upon trust to receive the dividends and interest thereof and expend the same in the purchase of bread to be distributed to the poor of the said parish upon the first day of January for every year forever I give and bequeath to the Vicar of the parish of Kingston aforesaid or other the Treasurer for the time being of the Kingston Sunday School the sum of forty pounds free of legacy duty upon trust to invest the same upon Government Security in his name and to receive the interest and dividends thereof and to apply the same in and towards the purposes of the said Sunday School forever And whereas there is a balance now due to me by Richard Shury Senior and James Shury Senior upon a certain bond or obligation under their respective hands and seals Now I do hereby give and bequeath unto the said William Ludlow Roberts Executors administrators and assigns to his and their own absolute and beneficial use all sum and sums of money which may have been recovered or received by my Executors in respect thereof in case the balance now due shall not be paid to me in my lifetime and as to all the Rest Residue and Remainder of my property and estate whatsoever and wheresoever I give the same and every part thereof unto my said nieces Sarah Stanford and Mary Woodhatch and my said nephew Charles Bythewood Stanford and their respective heirs administrators and assigns allowing to the nature thereof in equal shares as tenants in common and I do hereby declare that all the devises legacies bequests and dispositions herein given or made to or in favour of or for the benefit of my said nieces Sarah Stanford and Mary Woodhatch shall be for their own respective sole and separate use and benefit and independent of any husband or husbands whomsoever And I do hereby expressly declare that in case my said nephews and nieces or any other person named in this my Will shall anytime after my decease either by himself herself or themselves respectively or by any other person or persons whomsoever dispute or institute or commence or cause to be commenced or cause to be instituted any cause or process or other proceedings for avoiding frustrating or impeaching or by any other ways and means whatsoever shall seek or.....to avoid frustrate or impeach this my will or any or either of the dispositions thereby made than and in such case the bequest and bequests thereinbefore contained to or for the benefit of her him or them respectively so commencing or instituting any such suit process or proceeding or seeking or endeavouring as aforesaid shall immediately cease and determine and be absolutely void and such person or persons shall not be entitled to any benefit under this my will or any part of my estate and effects And I declare that every trustee or executor of this my will and their respective heirs executors and administrators out of the monies which shall come to his and their hands retain and pay to himself and themselves all costs and expences which they shall respectively sustain or be put unto in the execution of this my will and that neither of them shall be answerable and accountable for the other of them nor for the acts receipts or defaults of the other of them and I appoint the said William Ludlow Roots and George Roots Executors of this my Will hereby revoking all former and other wills by me made at any time theretofore made and so declare this only to be and contain my last will and testament In witness whereof I the said Elizabeth Bythewood have to this last will and Testament contained in six sheets of paper set my hand this eighteenth day of August in the year of our Lord
