In the Name of God Amen I SAMUEL BUCKLE of
Burton in Bishopdale [West Burton] in the County of York Esq do
make this my last Will and Testament in manner following that is to
say First I give and devise to SAMUEL SWIER of Connonly in the said
County of York Esq and MORRIS ROBINSON of the Six Clerks Office Esq
and JOHN YARKER of Middleham in the said County of York Esq all my
Personal Estate of what nature or kind whatsoever except such part
thereof as is herein otherwise disposed of Upon Trust towards the
payment of my debts legacys funeral expences ... I give and devise
all my messuages lands tenements and hereditaments whatsoever and
wheresoever lying of being until SAMUEL BUCKLE younger son of my
brother JOHN BUCKLE shall attain the age of 21 years upon trust ,...
that my said trustees .... apply the rents issues and profitts
towards the payment of my debts legacys as my Personal estate to
them devised shall fall short of paying and then upon trust to pay
thereout to my brother JOHN BUCKLE until my said nephew attains the
age of 21 years one annuity or yearly payment of £40 ... to be paid
at Lady Day and Michaelmas by equal payments ... the first payment
of the said days as shall happen after my debts and several legacys
hereby given shall be fully paid and discharged. And upon this
further trust and after my said nephew SAMUEL shall have attained
the age of 7 years to apply such part of the rents and profitts of
my estates ... towards the maintenance and education of my said
nephew until he attain the age of 21 years ... and JOHN YARKER shall
and may from the time of my decease until my said nephew shall
attain the age of 21 years retain out of the rents the yearly sum of
£10 as recompence to him for the trouble he may have in keeping the
accounts ... and after my nephew attain 21 years I do hereby charge
all and singular my messuages lands tenements and hereditaments with
the payment of an annuity or yearly sum of £40 ... to my brother
JOHN BUCKLE ... and after my said nephew shall attain the age of 21
years ... I give and devise all and every my said messuages lands
tenements and hereditaments unto my said nephew SAMUEL BUCKLE ...
and my trustees to have sole direction of my said nephew's education
from and after he has attained the age of 7 years And if my Brother
JOHN BUCKLE shall refuse .... I do hereby revoke and make void the
said annuity of £40 ... and if my said nephew SAMUEL BUCKLE shall
dye before he attain 21 years ... I devise all to SAMUEL SWIER,
MORRIS ROBINSON and JOHN YARKER until my nephew FRANCIS BUCKLE shall
attain the age of 21 years... subject to the same charges and
payments ... and I order my said nephew FRANCIS BUCKLE's education
shall be in like manner ... To each of my trustees I give £50 ... To
my nephews LUKE, JOHN and SAMUEL sons of my late brother YARKER I
give £20 apiece ... as they attain 21 years . To ELIZABETH the
daughter of my said brother JOHN BUCKLE I give £200 to be paid at
the age of 21 years ..... to my servant WILLIAM CHAPMAN I give £20.
to my cozen Mrs JANE SWIER of Shipton [or Skipton?] I give the use
of my Spring Clock for her Life and After her decease I give the
said Clock to my Godson SWIER of Cononley To Mrs SWIER of Cononley I
give my Chair and harness belonging it and my Black Mare . To the
said Mr MORRIS ROBINSON I give my own Picture and his own and his
Father's and Brother Jacky's Pictures and the two Landskips his
Father made me a Present of. To my nephew LUKE YARKER I give his
brother Frank's picture. To the said Mrs SWIER of Cononley I give my
marble table and frame in the Great Parlour And it is also my Will
that the two Sconce Glasses in the Hall and Great Parlour shall
continue there and go along with the House as Heirlooms. And I
further will that a monument shall be set up in Aisgarth Church by
my executors in the place where my mother and brother and sister
YARKER and nephew FRANK YARKER lye interred and that a marble plate
shall be framed in the pedestal of the said monument setting forth
the time of my own death and that my body lyes interred in the
churchyard. To my servant WILLIAM CHAPMAN I give all my wearing
apparell except my body linnen and that I give to my servant DOLLY
WILLIS And I will that the wall in ther Garden shall be finished by
my executors in the same manner it is begun ... I consitutute and
appoint SAMUEL SWIERS, MORRIS ROBINSON and JOHN YARKER executors ...

Codicil ..... whereas I SAMUEL BUCKLE of
Burton in Bishopdale in the County of York Esq ... I have given unto
my brother JOHN BUCKLE an annuity of £40 ... the said annuity shall
commence .... on 29 September or 25 March ... first shall happen
next after my decease ... my executors to keep my dwelling house in
Burton and garden belonging in good repair ... and shall not be let
to any person under the degree of a Gentleman ... to my Brother
JOHN BUCKLE I give all the malt liquor in my cellar whether in Casks
or in bottles which shall not be used at my funeral and to my said
brother and Mr JOHN YARKER of Middleham I give all my other Liquors
equally to be divided between them. To Mrs JANE SWIER of Skipton [or
Shipton?] I give 5 Guineas to buy mourning with and to Master JACKY
ROBINSON son of MATTHEW ROBINSON Esq I give my Gold Watch and
whereby I have by my will given my servant WILLIAM CHAPMAN a legacy
of £20 I now do hereby revoke the said legacy and in lieu give to my
said servant £10 only. To each of my servants I give mourning And to
my servant boy LEONARD I give One Guinea in satisfaction of all
demands he may have upon me. In witness whereof I have hereby set
