The Will of William Brumfitt

 

This is the last will and testament of me William BRUMFITT of Hatton Hill Ford near Liverpool Gentleman I appoint my daughter Mary BRUMFITT and my friends Joseph SHARPE of Old Hall Street Liverpool Printer and stationer and James PENDLETON of Liverpool Ironfounder (hereinafter called my trustees) to be the executors and trustees of this my will and I declare that all trusts and powers hereafter reposed and vested in my trustees shall or maybe exercised by the survivor or survivors of them or their heirs executors or administrators or such survivor or other the trustees or trustee for the time being of this my will I bequeath the following specific legacies namely to my son Charles the silver watch and goblet presented to me by the Liverpool Rodney Ward Committee and to my daughter Emma my gold watch and chain I hereby confirm the gift made many years since to my daughter Mary of the pianoforte now in my dwelling house I also bequeath the following pecuniary legacies namely to my daughters Mary and Emma in equal shares and proportions all the ready money of which I shall die possessed or which shall be invested in any bank or building or other society to my brother Thomas ten pounds to my present house keeper Mary Ann SEYMOUR in case she shall be living and in my service at the time of my decease the sum of ten pounds I devise and bequeath all my real and personal estate not hereby otherwise disposed of unto my trustees upon trust that they my trustees shall sell call in and convert into money the same and shall with and out of the monies produced by such sale calling in and conversion pay my funeral and testamentary expenses and debts and the legacies bequeathed by this my will and shall invest the residue of the said monies in their names in or upon the public stocks or funds or government securities of the United Kingdom or India the stocks of The Bank of England commonly called Bank Stock Freehold copyhold or leasehold securities in England or Wales and not Debenture the bonds of the Liverpool Corporation the Liverpool Mersey Docks and Harbour Board the bonds debentures mortgages guaranteed stock or securities of any corporation Railway Company or public bond in the United Kingdom regularly paying a dividend and my trustees shall have power to vary from time to time or to transpose such stocks funds or securities into or for others of the same or a like nature and that my trustees shall stand possessed of the said residuary trust monies and the securities for the same hereinafter called my trust fund upon the trusts following (that is to say) in trust to pay to my wife Margaret during her life the sum of fifteen shillings weekly and every week the first weekly payment to be made at the expiration of one week next after my decease and subject thereto shall stand possessed of the said trust fund and the securities for the same its to one equal fourth part thereof in trust for my son Charles absolutely and as to the remaining three fourth parts thereof in trust for my daughters Mary and Emma in equal shares and proportions the share of each to be for her own sole and separate use provided always and I declare that if any of my said children  Mary, Emma and Charles shall die in my lifetime without leaving issue as well the original share of any such child dying do also any share or shares accruing to him or her under this provision shall go to the others or other of them and if more than one in equal shares provided also and I further declare that if either or any of them the said Mary, Emma or Charles shall die in my lifetime leaving a child or children who shall survive me and shall attain the age of twenty one years then and in every such case such child or children should take (and if more than one equal between them) the share (as well original or accruing) which his her or their parents would have taken under this my will if such parent had survived me and I declare that my trustees may postpone the sale and conversion of my real and personal estate or any part thereof for so long as they shall think fit and that the rents profits and income to accrue from and after my decease of and from such part of my estate as shall for the time being remain unsold and unconverted shall after payments thereout of all incidental expenses and outgoings be paid and applied to the person or persons and in the manner to whom and in which the income of the monies produced in such sale and conversions would for the time being be payable or applicable under this my will if such sale and conversions had been actually made I devise and bequeath all estates vested in me as a trustee or mortgagee unto my said trustees subject to the trusts and equities affecting the same respectively In witness whereof I have hereunto set my hand this fourteenth day of March one thousand eight hundred and seventy seven

This is a codicil to the above written last will and testament of me the before named William BRUMFITT whereas the before named Joseph SHARPE has lately died now I hereby appoint Edwin SMITH of Breeze Hill Walton near Liverpool clerk to the Walton Local Board to be one of the trustees and executors of this my will in the place of the said Joseph SHARPE deceased and I declare that my said will shall be construed and take effect as if the name of the said Edwin SMITH were inserted in my said will throughout instead of the name of the said Joseph SHARPE and in all other respects I confirm my said will In witness whereof I have hereunto set my hand this second day of December one thousand eight hundred and eighty five

Proved at Liverpool with a codicil the 6th May 1890 by the oaths of Mary BRUMFITT spinster the daughter and James PENDLTON the executors named in the will to whom administration was granted Edwin SMITH the executor named in the said codicil having renounced the probate and executor of the said will and codicil

 

The testator William BRUMFITT was late of Halton Hill Road near Liverpool in the county of Lancaster gentleman and died on the 14th April 1890 at Halton Hill aforesaid
