I Emma Brumfitt of 21 Oban Road Anfield in the
City of Liverpool spinster hereby revoke all former wills and
testamentary dispositions made by me and declare this to my last
will and testament. I appoint my nephew George Brumfitt of 21 Oban
Road aforesaid and my nephew Charles McIntyre Brumfitt of 298
Longmoor Lane Fazakerley in the said City (hereinafter called my
trustees to be the executors and trustees of this my will. I give
the following specific legacies free from duty) namely (a) to my
nephew the said Charles McIntyre Brumfitt my twenty ordinary shares
in the Soho Building Society (b) to my nephew the said George
Brumfitt my five shares in the British Building Society to my
grandniece Margaret Jane Brumfitt the daughter of my nephew the said
Charles McIntyre Brumfitt my watch and chain formerly belonging to
my late niece Margaret Ellen Brumfitt in accordance with her wishes
(d) to Lizzie Brumfitt the wife of my nephew the said George
Brumfitt my cameo brooch my amethyst brooch and my diamond and pearl
ring (e) to Mary Elizabeth Brumfitt the wife of my nephew the said
Charles McIntyre Brumfitt my ruby and diamond ring my large silver
and pebble brooch and my gold and turquoise ring (f) to Elizabeth
Doddridge the wife of Edward Doddridge my silver brooch with gold
bird and leaves and my silver Albert chain (g) to my grandniece
Florence May Brumfitt the daughter of my nephew the said George
Brumfitt my diamond ring and my pendant chain (h) to my grandniece
Dorothy Brumfitt the daughter of my nephew the said George Brumfitt
my gold watch and chain (I) to my nephew the said George Brumfitt my
gold watch and chain formerly belonging to my late father (j) to my
nephew the said Charles McIntyre Brumfitt the silver presentation
cup formerly belonging to my late father (k) to my niece Emma Mary
Bradshaw Brumfitt the daughter of my late brother Charles Brumfitt
all my furniture and household effects being in or about or
appropriated or belonging to the dwelling house being no. 103
Hershall Street except the silver presentation Cup lastly
hereinbefore mentioned (1) to my nephew the said George Brumfitt all
my furniture and household effects being in or about or appropriated
or belonging to my said dwelling house no. 21 Oban Road aforesaid
(3) I give to the said Edward Doddridge the sum of ten pounds (free
from duty) (4) I devise and bequeath all my real and personal estate
not hereby otherwise disposed of unto my trustees upon trust that my
trustees shall sell call in and convert into money the same or such
part thereof as shall not consist of money and shall with and out of
the monies produced from such sale calling in and conversion and
with and out of my ready money pay my funeral and testamentary
expenses and debts and the legacies bequeathed by this my will or
any codicil hereunto and shall stand possessed of the said residuary
trust monies and the investments for the time being representing the
same (hereinafter called the residuary trust funds) In trust for
such of them my four nephews the said Charles McIntyre Brumfitt,
George Brumfitt, Thomas Brumfitt and Alfred Brumfitt and my niece
the said Emma Mary Bradshaw as shall be living at my death and if
more than one in equal shares Provided always that if any of them my
said nephews or my niece shall have died in my lifetime leaving
issue living at my death such issue being male and attaining twenty
one years and being female and attaining that age or marrying under
that age shall take by substitution if more than one in equal shares
the share of and in the residuary trust funds which such deceased
nephew or niece would have taken if he or she had survived me and
attained a vested interest (5) And I declare that my trustees may
postpone the sale and conversion of any part of my real and personal
estate (including leaseholds or other property of a terminable or
wearing our nature) for so long as they shall think fit and that the
rents profits and income to accrue from and after my decease of and
from such part of my estate as shall for the time being remain
unsold and unconverted shall after payment thereout of all
incidental expenses and outgoings to be paid and applied to the
person or persons and in the manner to whom and in which the income
of the proceeds of such sale and conversion would for the time being
be payable or applicable under this my will if such sale and
conversion had been actually made (6) I declare that in addition to
any investments from time to time sanctioned by law for the
investment of trust funds all moneys to be invested under this my
will may at the discretion of my trustees be invested in or upon one
or more of the following investments or securities (that is to say)
(1) Any of the public stocks or funds or government securities of
Great Britain or India or any British Colony or Dependency or any
foreign government or state (20) Mortgages of land messuages or
other hereditaments in England or Wales (including copyhold
hereditments and leasehold hereditments ???? for any term whereof
not less than sixty years shall be unexpired at the time of
investment) (3) The bonds debentures debenture stock guaranteed
preference or ordinary stocks or shares of any company or public
municipal or local body or authority in the United Kingdom or India
or any British Colony or Dependency or any foreign Country with
power from time to time to vary such investments for others of a
nature ????? and
I declare that my trustees shall have the
following powers (a) To manage repair insure demise for the term of
years or tenancy and at any rent and deal and arrange with tenants
of any real or leasehold hereditments hereinbefore given in trust
for sale until the same shall be sold at their uncontrolled
discretion as if my trustees were absolute beneficial owners thereof
(b) To appropriate and partition any real or personal property
forming part of my residuary estate to or towards the share of any
person or persons therein under the trust hereinbefore contained and
to charge any share with such sums by way of equality of partition
as they may think fit And I declare that every such valuation
appropriation and partition shall be binding upon all persons
interested under this my will or any codicil hereto (c) At their
uncontrolled discretion instead of acting personally to employ and
pay any other person or persons to transact any business or to do
any act of whatever nature in relation to the trusts hereof
including the receipt and payment of money without being liable for
loss occasioned thereby
