I Charles Brumfitt of 103 Herschall Street in
the city of Liverpool, Gate keeper, hereby revoke all testamentary
instruments hereto afore made by me and declare this to be my last
will. I appoint my sister Emma Brumfitt and my daughter Margaret
Ellan Brumfitt to be the executives and trustees of this my will and
they and the survivor of them and the executors or administrators of
such survivor are hereinafter referred to as my Trustees. I devise
and bequeath all my real and personal estate whatsoever unto my
Trustees upon trust that they shall sell, call in and collect the
same and shall out of the monies arising thereby and all other
monies forming part of my estate, pay my funeral and testamentary
expenses and debts and the duty on the annuity hereby bequeathed and
shall invest the residue of the said monies in the names or under
the legal control of my Trustees in or upon any of the public stocks
or funds or Government securities of the United Kingdom or India or
any colony or Dependency of the United Kingdom or upon freehold,
copyhold, leasehold or chattel real securities in England or Wales
or in or upon the Debentures, Debenture stock, mortgages or
securities of any Company, Corporation or Body, whether commercial,
municipal, county, local or otherwise carrying on business or
constituted for any purpose in Great Britain or in or upon the
Debentures, Debenture stock or guaranteed or preference stocks or
shares or annuities of any Railway, Canal, Dock, Harbour, Gas, Water
or other company or body in Great Britain incorporated by Act of
Parliament or Royal Charter and may vary such investments at their
discretion and I expressly declare that my Trustees may retain any
securities or investments of which I may be possessed at the time of
my death so long as they may deem proper without being responsible
for any loss or depreciation thereby sustained and shall out of the
income of the said trust monies and the investments for the time
being representing the same pay and annuity of Fifty pounds free of
duty to my said daughter Margaret Ellan Brumfitt during her life
commencing from my death to be payable by equal monthly payments the
first payment to be made at the expiration of one month from my
death and shall pay the residue of the income of the said trust
monies to my said sister Emma Brumfitt during her life and after the
death of my said sister Emma Brumfitt shall hold the said trust
monies and the income thereof in trust for my said daughter Margaret
Ellan Brumfitt absolutely. But if my said daughter Margaret Ellan
Brumfitt shall die in the lifetime of my said sister Emma Brumfitt
then my Trustees shall hold the said trust monies and the income
thereof in trust for my said sister Emma Brumfitt absolutely
provided always that my Trustees may wholly or partially postpone
the sale of my share of the freehold properties in Canterbury
Street, Bidder Street and Doddridge Street Liverpool owned by me
jointly with my said sister and all other my real estate and also
the conversion and collection of my said personal estate so long as
they deem proper. My real estate being nevertheless considered as
personally from my death and may during such postponement manage and
let for any term of years at such rent my real and leasehold estates
and make any outlay which they may consider proper for the benefit
or in respect of my said real and personal estate. But the income
produced during such postponement from all or any part of my estate
howsoever invested and of whatsoever description shall as from my
death be applicable as income and no property not actually producing
income shall be treated as producing or entitling anyone to receipt
of income. In witness whereof I have hereunto set my hand this
Twenty sixth day of July one Thousand eight Hundred and Ninety nine.
