This is the last Will and Testament of me Edmund Boghurst of Kingston in the Parish of Portsea in the County of Hants Builder - I hereby nominate and appoint my friends John Green of Hilsea in the said County Yeoman and Charles Matthew of Buckland in the Parish aforesaid Brewer Executors of this my Will- I Give and bequeath my Silver Cream Jug and my Silver Salt cellars with the Spoons belonging to the same unto my Daughter Harriet the Wife of John Brown of Portsea aforesaid Gentleman to and for her own Use benefit and disposal- I Give and bequeath All that my Messuage or Dwellinghouse and Carpenters Shop with the Yard Garden Outlet and Appurtenances thereto belonging situate and being or near Kingston Cross aforesaid and now in my own occupation- And all and every other of my Messuages Lands Tenements and Hereditaments whatsoever and wheresoever situate and being whereof wherein or whereto I am in any way seized possessed or entitled or over which I have any disposing Power unto the said John Green and Charles Matthews their Heirs Executors Administrators and Assigns according to the different Tenures of such Messuages Lands and Hereditaments respectively Upon Trust that they the said Trustees and the Survivor of them his Heirs Executors and Administrators shall and do (when they or he shall deem it proper) after my decease sell and dispose of all and singular the said Messuages Lands and Hereditaments either together and in one lot or in several lots and either by public Sale or Private Contract as to them my said Trustees or Trustee shall seem meet And also make execute and perfect all necessary or proper writings Conveyances and Assurances for vesting the same in the Purchaser or Purchasers thereof and for such Uses intents and purposes as as he She or they shall direct or appoint And for facilitating such sale of the said Messuages Lands and Hereditaments I do hereby direct and declare that the receipt or receipts of my said Trustees and the Survivor of them his Heirs Executors or Administrators shall be a good and sufficient discharge or good and sufficient discharges to the Purchaser or Purchasers thereof for his her or their purchase money and such purchaser or purchasers shall not be ob;iged to see to the application of such purchase money or to be in any ways answerable or accountable for the misapplication or non application thereof or of any part thereof And I will and direct that they my said Trustees and the Survivor of them his Executors and Administrators do and shall stand and be possessed of the Monies to arise by such sale or Sales and the rents and Profits of the said Messuages and Hereditaments in the mean time until such Sale in and upon the Trusts intents and purposes hereinafter expressed concerining the same And I give and bequeath All my household Goods and furniture Plate linen and china Stock in Trade ready money and Securities for money Book and other Debts and all the rest residue and remqainder of my personal Estate Goods Chattells and effects (not hereinbefore disposed of) unto the said John Green and Charles Matthews their Executors Administrators and Assigns Upon trust that they the said Trustees and the Survivor of them his Heirs Executors and Administrators do and shall convert into money such part or parts thereof as shall not consist of money at the time of my decease and as to the monies to arise therefrom and the money to arise or be produced by sale of my said Messuages and Hereditments (subject nevertheless to the payment of my Debts and funeral and testamentary expences) I will and direct that they the said Trustees and the Survivor of them his Executors and Administrators shall and do lay out and invest such respective monies to some or one of the public Stocks or funds of this ..... or upon other real Securities (which Stocks funds and Securities they or he are hereby authorised and..... to alter and change as often as they or he shall see occasion) And do and shall pay apply and dispose of the Interest Dividends and Annuel Proceeds thereof And the rents issues and profitts of such my Said Messuages and Hereditaments as shall remain unsold as and when the same shall respectively come due and be received Unto and for the Maintenance Education and bringing up of such of my Children as shall be under the Age of Twenty one years at the time of my decease until the youngest of my said children shall attain his or her age of Twenty one years And when and as soon as such youngest child shall have attained his or her age of twenty one Then Upon Trust to pay Assign and transfer the whole of the said Trust monies and Effects unto my children Edmund, Harriet the Wife of the said John Brown, John Horn, Thomas, George, William and Elizabeth to be equally divided between them share and share alike And in case the Youngest of my said Children shall happen to die before he or she shall have attained the said age of twenty oneThen the division and transfer of my said Trust monies and Effects shall be when the next youngest of my said Children shall attain that age and soon and in like manner with respect to my other Children shall attain that age and soon and in like manner with respect to my other Children It being my will and meaning that the said Division and Transfer shall take place and be made when my youngest surviving Child shall attain his or her age of twenty one years -Whereas for the further and better advancement of several of my said Children in life I have at different times and on various occasions paid laid out and expended the several Sums following (that is to say) for and on account of my said Son Edmund the Sum of Thirty Pounds for and on account of my said Daughter Harriet the Sum of Fifty Pounds for and on account of my said Son John Horn the Sum of one hundred Pounds and for and on account of my said Son Thomas the Sum of Fifty pounds Now my will and Meaning is And I hereby direct and declare that they my said Children namely Edmund, Harriet, John Horn and Thomas, shall not have or receive or be intitled to so great a share or proportion of the said Trust monies and effects as each of my said other Children by the value or amount of the said aforementioned several Sums as I have advanced and paid for them respectively as aforesaid - And I hereby direct and declare that they my said Trustees and Executors their Executors and Administrators shall not be answerable or accountable for more monies than they shall respectively actually receive nor with or for any loss which may happen to the said trust monies and premises so as such loss happen without their respective wilfull default nor one of them for the other of them but each for his own Acts receipts defaults or disbursements of the other of them but each for his own Acts receipts defaults or disbursements only And also that it shall and may be lawful to and for my said Trustees and Executors their Heirs Executors and Administrators to reimburse themselves respectively all such loss costs charges and expences as they respectively shall sustain expend or be put unto in or about the execution of this my Will or the Trusts hereby in them reposed - And hereby revoking and making void all former and other Wills by me at any time heretofore made I Publish and declare this to be and contain my last Will and Testament only In Witness whereof I the said Edmund Boghurst the Testator have to this my only last Will and Testament contained in three sheets of paper set my hand and seal (that is to say) my hand to the two sheets hereto annexed and my hand and seal hereto the Thirtieth day of March in the Year of our Lord one thousand eight hundred and fifteen
