The Will of John Birbeck

 

6 September 1766 the will of JOHN BIRBECK in the following words.

 

I JOHN BIRBECK of Whitaside in the parish of Grinton in the County of York mason do make publish and declare this my last will and testament as follows that is to say Whereas I have already made some provision for my younger son JOHN BIRBECK by conveying to him part of my real estate now I do hereby as far as I can ratify and confirm the same to him the said JOHN BIRBECK his heirs and assigns for ever and further I do hereby give and bequeath to my said son JOHN BIRBECK All that my leasehold close or parcel of ground called the Croft situate in Whitaside and now in the occupation of JOSEPH STODDART ... to hold unto my said son JOHN BIRBECK ... during the remainder of the term of years to come therein. And I give and devise all the residue of my messuages lands tenements and hereditaments and real estate whatsoever and wheresoever to my oldest son JAMES BIRBECK his heirs and assigns for ever and I give and bequeath all my goods and chattells and personal estate whatsoever to my two sons JAMES BIRBECK and JOHN BIRBECK equally to be divided between them and I do hereby appoint JAMES BIRBECK and JOHN BIRBECK executors of this my will In Witness whereof I have hereby set my hand and seal this 6 September 1766

 

executed in the presence of three witnesses [not named]
