10 August 1792 Office copy will of the said JAMES BIRBECK

In the Name of God Amen [next bit missing] and publish this my last will and testament in manner and form following that is to say First I bequeath to my daughter NANCY BIRBECK £300 principal sum or £12 a year during the term of her natural life at the discretion of my executors to be paid out of my estate. Likewise I give her half of all my household furniture.

Item to my dear wife ANN BIRBECK I give £12 a year during the term of her natural life in lieu of her thirds ... and lastly to all the rest and residue remainder of my personal estate and likewise all my lands and real estate ... I give and bequeath the same to my son JOHN BIRBECK whom I appoint sole executor of this my last will and testament. But in case my son JOHN BIRBECK should die before my daughter NANCY my will is that JAMES SPENSLEY of Gunnerside should be a trustee for my said daughter NANCY BIRBECK and in case my son JOHN BIRBECK and JAMES SPENSLEY should both die before my daughter Nancy I will those persons to be trustees for my said daughter who they or either of them shall by will dem=nominate and appoint as their successors In Trust for her . I wish this my last will and testament to be farely duely executed according to uts truest intent and plainest meaning hereby revoking all former wills by me made In witness whereof I have hereby set my hand and seal this 10 August 1792
