In the Name of God Amen I the Revd John
Bellward Rector of Burgh Castle in the County of Suffolk being of
sound disposing mind and memory praised be God Do make publish and
declare this to be my last Will and Testament in manner following
that is to say I give and devise unto Ann my Wife and
to her Heirs and Assigns for ever all that my Messuage or Ffarmhouse
with the barn stable outhouses and buildings and also all the Lands
grounds hereditaments and Appurtenances thereunto belonging situate
and lying in Burgh Castle aforesaid in the Tenure use or occupation
of John Woodcock his Assigns or under Tenants and also all other my
Messuages Lands Tenements and hereditaments whatsoever in Burgh
Castle aforesaid or elsewhere in the Kingdom of Great Britain Also I
give to my said Wife such and so many of my books manuscripts and
maps as she may choose to take for her own use and as to such of
them as she shall not choose to take for herself I give the same to
Thomas dicks of Jesus College in the University of Cambridge
Gentleman for his own use and benefit for his care and trouble in
and about the execution of the Trusts of this my Will Also I give to
George Dicks of Lambeth in the County of Surry Gentleman the Sum of
twenty Guineas for his Care and trouble in and about the execution
of the trusts of this my Will Also I give to my said Wife and to the
said George Dicks and Thomas dicks The Sum of two thousand and ffive
hundred Pounds upon the Trusts and to be applied for the several
uses and in manner hereinafter mentioned and Directed Concerning the
same and as to my household Goods and FFurniture Plate and Linen
horses(?) and Chaise(?) all my Ready Money Debts Due or owing to me
and Securities for money and all other my Goods Chattels and
personal Estate whatsoever and Wheresoever save and except what I
have hereinbefore given and bequeathed I give and bequeath the Same
and every part thereof to my Said Wife absolutely to and for her own
Sole use benefit and Disposal Subject however to the payment of my
just Debts FFuneral and Testamentary Expenses and Subject also and I
subject and charge the same to and with the payment of the Several
Annuities which William Kitteridge late of Lowestoft in the
County of Suffolk Gentleman the ffather of my said Wife in
and by his last Will and Testament gave to Mary Burgess now called
Mary Farmer Widow in certain events therein Specified and for
payment whereof the said William Kitteridge charged certain parts of
his personal Estate And subject likewise to the payment of any other
Sum or Sums of money which any person or persons under and by Virtue
of the said Will of the said William Kitteridge Can or may claim or
eventually be intitled to out of or from his personal Estate my
meaning being that the said Sum of two thousand and five hundred
Pounds given as aforesaid upon the trusts hereinafter mentioned or
any part thereof shall not be Subject or liable to the payment of
the Said Annuities or Sums of money or any of the _____ further than
my said Wifes life Interest therein is confirmed(?) and as to for
and Concerning the Said sum of two thousand and five hundred Pounds
hereinbefore given to my Said wife and to the said George Dicks and
Thomas Dicks the same is so given to them upon the Trusts and for
the Several uses intents and purposes following that is to say In
Trust and I desire my said trustees to put and keep the same
principal Sum of Money out at Interest during my said Wifes life
upon such Security or Securities as she shall from time to time
approve of But at the Risk and hazard of the several persons
intitled then to give and Direct shall be paid in manner following
that is to say I give thirty pounds part of such Interest yearly and
every year during the joint lives of my said Wife and of Sarah
Bellward Spinster my Sister To my said Sister for her own
use to be paid at four quarterly payments in the year the first
payment thereof to be made and paid at the end of three calendar
months next after my decease and all the rest and residue of the
said Interest monies I give to my said wife During her life for her
own use and benefit and In Case my said sister should Die in the
life time of my said Wife then and in such Case I give the whole
Interest Produce and Profit of the said two thousand and five
hundred Pounds to my said Wife during her Life for her own use But
if Case my said Wife should die in the life time of my said Sister
then my meaning is that the said Annuity of thirty Pounds shall
cease and determine Immediately upon the Decease of my said Wife and
from and immediately after my said Wifes Decease I direct the said
George Dicks and Thomas Dicks or the Survivor of them his Executors
Administrators to put place and keep out at Interest One thousand
Pounds Part of the said two thousand and five hundred Pounds on such
Security or Securities as they shall from time to time think proper
but at the risk and hazard of the persons intitled hereto by this my
Will and I give and bequeath to my said Sister Sarah Bellward Yearly
and every year during her own life twenty pounds part of such
Interest to be paid quarterly as aforesaid the first payment thereof
to commence and be paid at the end of three calendar months next
after the Death of my said Wife and all the remaining Interest of
the Said Sum of One Thousand pounds I give to my Niece Esther
Moyse for her life and after her Decease to her husband
Richard Fielding Moyse for the remainder of his Life and from and
after the Decease of my said Sister I give the whole Interest the
said One thousand Pounds to the said Esther Moyse and Richard
Fielding Moyse for their Lives and the Life of the Survivor
of them and from and after the Several(?) Deceases of the said
Esther Moyse and Richard Fielding Moyse and of my said Sister I give
the said Principal Sum of one thousand Pounds to and be equally
Divided among and between all the lawful Children of my said Niece
Esther Moyse which shall be then living and to the Issue of such of
them as may be then Dead such Issue to take only the part or share
which his her or their Father or Mother would have been intitled to
if living such respective shares to be paid at the respective Ages
of twenty One Years of my said Legatees but if my said niece Esther
Moyse should die without leaving any Issue then I give the said One
thousand Pounds to be equally divided among and between John
Bunn, Ann Bunn Elizabeth Bunn and Mary Bunn the children of my Niece
Elizabeth Bunn Deceased or such of them as shall be living
at the time of the Decease of my said Niece Esther Moyse to be paid
at their several Ages of twenty One Years and in Case only One of
them shall be then living then I give the whole thereof to such
Surviving Child at its Age of twenty One years and as to the other
one thousand Pounds I desire my said Trustees after my said Wifes
Decease to put place and keep the same out at Interest or such
Security or Securities as they shall from time think proper during
the life of my said Sister Sarah Bellward but at the risk of the
Person Intitled thereto by this Will and I give and bequeath yearly
and every year to my said Sister During her Life twenty Pounds part
of such Interest of the last mentioned One thousand Pounds to be
paid quarterly as aforesaid the first payment thereof to Commence at
the end of three Calendar Months after the Decease of my said Wife
and all the Remaining Interest of the said last mentioned One
thousand Pounds I give to my Niece Ann Howell Spinster
Daughter of my Sister Elizabeth Howell for her own use but
in Case my said Sister Sarah Bellward should be Dead at the time of
my said Wifes Decease or if not then when and so soon afterwards as
the Death of my said sister shall happen I give the said last
mentioned sum of One thousand pounds and direct my said Trustee to
pay the same to my said Niece Ann Howell to and for her own Sole use
and benefit and ____ and as to three hundred pounds further part of
the said two thousand fiver hundred pounds I desire my said
trustees after my said Wifes decease to put the same Out to Interest
on such Security or Securities as they shall from time to time think
proper but at the risk of the Persons Intitled thereto by this my
Will And all the Interest thereof I give to my Niece Sarah
Holmes During her life for her own use and benefit and after
her Decease I give the said Principal Sum of three hundred Pounds to
be Divided among all the Children of my said Niece Sarah Holmes
which shall be then living and to the Issue of such of them as shall
be then dead such Issue to take only the part or share which his her
or their father or mother would have been intitled to if living the
respective shares whereof I desire shall be paid at the respective
ages of twenty One years of my said Legatees but if my said niece
Sarah Holmes should Die without having any lawful Issue then I give
the said three hundred pounds to be equally divided among and
between the lawful Children of my Niece Jane West
which shall be then living share and share alike but in the event of
my said Niece Sarah Holmes Death without Issue my will and meaning
is that my said trustees before they Pay the said three hundred
pounds in manner in such Contingency before directed shall retain so
much thereof in there hands as will enable them to pay two Shillings
and Six pence weekly and every week to my said Niece Jane West
During her life to whom I give the same accordingly and as to One
hundred Pounds further Part of the said two thousand and five
hundred Pounds I give the same to my Nephew John Calvor
for his own use and benefit to be paid within three Calendar Months
next after my said Wifes Decease and as to One hundred Pounds
residue of the said two thousand five hundred pounds I give the same
to my Niece Mary Knights for her own use and benefit
to be paid within three Calendar Months next after my said Wifes
Decease and I nominate Constitute and appoint the said Ann my Wife
to be Sole Executrix of this my last Will and Testament hereby
revoking all others by me at any time heretofore made and my Will is
that the Provision that I have hereinmade for my said Wife is to be
excepted in Satisfaction and Discharge of all Securities and
Engagements which I am under to provide for her in the Event of her
Surviving me in Witness whereof I the said John Bellward the
testator have to this my last Will and Testament Contained in five
sheets of Paper and affixed together at the Tops to the first second
third and fourth Sheets thereof Set my hand and to the fifth my hand
and Seal this twenty first Day of June in the year of Our Lord One
Thousand Seven hundred and Ninety two ~ John Bellward ~ Signed
Sealed Published and declared by the testator as and for his last
Will and Testament in the presence of us who in his presence and at
his request and in the presence of each other have subscribed our
Names as Witnesses thereto Robt Reeve –Robert Morris – Chars Thacker
This Will was proved at London the Second Day
of January in the year of Our Lord One thousand Eight hundred and
One before the Right Honorable Sir William Wynn Knight Doctor of
Laws Master Keeper Commissary of the Prerogative Court of Canterbury
lawfully Constituted by the Oath of Ann Bellward and Widow the
Relict and Sole Executrix named in the said Will to whom
Administration was granted of all and Singular the Goods Chattels
and Credits of the said Deceases having been first Sworn by
Commission duly to Administer |
