The Will of Phillip Bax

 

In the Name of God Amen I Phillip Bax of Capell in the County of Surrey yeoman being at this time in Tolerable good bodily health And of Sound an d disposing Mind Memory and Understanding thanks be to Almighty God and calling to Remembrance the Uncertainty of this Transitory life do make & also ordain this my last Will and Testament in manner and fform as followeth that is to say first being penitent and Heartily sorry for all my Sins humbly begging forgiveness of the same I bequeath my Soul unto Almighty God and my Body to the Earth to be decently buryed and for the settling of my Worldly estate with which it hath pleased the Almighty of his Great Goodness to bless me with I so order give and dispose thereof as followeth that is to say first I will all my just Debts shall be paid and discharged and then I give and bequeath unto my two nephews Richard Bax and Daniel Bax Sons of my Brother Daniel Bax deceased each the Sum of Ten Shillings and I give and bequeath unto my Sister in Law Susanna Bax Widow of my said Brother Daniel Bax the Sum of Ten Pounds and I give and bequeath unto my Niece Mary Bax Daughter of my said Brother Daniel Bax the Sum of one Hundred Pounds and I give and bequeath unto my niece Roberta Bax another Daughter of my said Brother Daniel Bax the Sum of one Hundred and forty Pounds and I give and bequeath unto my niece Ruth Bax another Daughter of my said Brother Daniel Bax the Sum of one Hundred Pounds all these Legacys to be paid within twelve months next after my decease and I give and bequeath unto my kinswoman Ruth Tully Daughter of my kinsman John Tully the sum of fifteen pounds and to Martha Mary Samuel Hannah and Ann five other children of my said kinsman John Tully each the sum of ten pounds these legacys to the six children of John Tully to be paid within twelve months next after my decease and in Case they or anyone or more of the said Legacys are not paid within the Twelve Months then my Will is that my Executors shall pay Interest for the same to each Legatee whose Legacy is not paid at the rate of four pounds in the hundred by the year till such Legatee or Legattees shall attain the age or ages of Twenty one years and then to pay the Legacy or Legacies and if one or more of the aforesaid Six Children od the said John Tully shall happen to dye before their Legacy is paid then in that Case my Will is that the Legacy or Legacys of them so dying shall be divided between the Survivors share and share alike And I give and bequeath unto my kinswoman Mary Parsons the Sum of five pounds and I give and bequeath unto Richard Gates the sum of five pounds And I give and bequeath unto the poor of the parish of Capell aforesaid the sum of fforty shillings to be distributed by the Churchwardens and overseers as they shall think proper Objects of Charity these three last Legacies to be paid within Twelve Months next after my decease nevertheless if it shall so happen that my two Nephews above named Richard Bax and Daniel Bax or any one of them be living at the time of distributing the fforty shillings amongst the Poor of Capell my Will in that Case is that they shall distribute the same unto such persons as they shall think proper Objects of Charity and I devise give and bequeath unto my Kinsman John Tully and Anne his Wife all those my Customary Messuages or Tenements ffarms Lands and Premises with the Appurtenances called or known by the Name or Names of Missbrooks Aldhurst and Hatch Land and all other my Customary Lands and Premises with the Appurts situate in Capell aforesaid and are now Partly in my own Occupation and Partly in the Occupation of the said John Tully holden of the Manor of Dorking I having hereby surrendered the same to the use of my Will to have and to hold the same unto the said John Tully and Anne his Wife and to their Heirs and Assigns forever nevertheless my Will and meaning is that the said John Tully and Anne his Wife and their Heirs and Assigns shall pay out of the said Messuage ffarm and Lands called Missbrooks the sum of five pounds yearly and every Year to my Kinswoman and Housekeeper Susannah Parsons by two even and equal yearly Payments during the term of her natural life to Service the payment whereof I do hereby Charge and Subject the said Messuage ffarm and Lanes called Missbrooks so bequeathed to the said John Tully and Anne his Wife as aforesaid and all the rest and Residue of my Goods Chattells and my ready money and personal Estate whatsoever after my just Debts ffuneral Expences and Legacies are paid and discharged and is not herein bequeathed I give and bequeath unto the above named John Tully and Anne his Wife whom I do hereby nominate make and appoint full and sole Executors of this my last Will and Testament ratifying and confirming this and none other to be my last Will and Testament In Witness whereof I have to this my last Will and Testament Set my hand and seal the Seven and Twentieth day of May in the year of our Lord one thousand seven hundred and fifty five  Philip Bax
