In
the Name of God Amen I CHARLES BATHURST of Skutterskelf in the
County and Diocese of York being of sound and perfect disposing mind
and memory Praised be Almighty God for the same and considering the
uncertainty of this life and that it is the duty of every Christian
to settle his affairs whilst opportunity is given and being minded
to make such provision for my dear and well beloved wife as God
Almighty is his great Goodness hath enabled me to do and to prevent
disputes and differences after my decease do make and ordain this my
last will and testament as followeth. First and principally I
recommend my sould into the hands of Almighty God hoping through the
merits of his death and passion of my dear Saviour and Redeemer
Jesus Christ to obtain pardon and forgiveness for all my sins and my
body I commit to the Grave to be decently interred at the discretion
of my Executrix hereinafter named And as to the worldly estate which
it hath pleased god in his goodness to Bestow upon me I give and
dispose thereof as followeth that is to say I give devise and
Bequeath to my dear and well beloved wife ANNE BATHURST and to her
heirs and assigns forever All and every my messuages houses
outbuyildings yards garths gardens orchards lands and grounds
tenements and hereditaments farms lead mines and other mines rights
and premises with their and every of their appurtenances scituate
standing lying and being within the parishes of Rudby, Marskm
Arkendale [Arkengarthdale] , New Forrest and Richmond in the said
County of York and all other my Real Estate whatsoever and
wheresoever and also all and every my Ready Money Plate Rings Linen
household goods and horses cows sheep and all other my goods cattle
chatles and personal estate .... To hold all and every my said real
and personal estate ... to my dear wife ANNE BATHURST ... subject
nevertheless to the payment of all my just debts ... and I do charge
all my real and personal estate with the payment of my just debts
... And I also constitute and nominate and appoint my said well
beloved wife ANNE BATHURST sole executrix hereby revoking and
annulling all former and other wills .... And lastly I do hereby
request and desire my brother in law JOHN HENDRY of Stockton upon
Tease in the County of Durham Esq and my good friend THOMAS BUDD of
the City of Durham Esq to be aiding and assisting to my said dear
wife in the management of her affairs ...
In
witness wereof I the said CHARLES BATHURST have to this my last will
and testament set my hand and seal the 29 September in the 14th year
of George II 1740

An
identical will was also copied into the Deed registry dated 5
January 1739 with witnesses John Hendry, James Hird and William
Lawson
