The Will of Jonas Bateman

 

Will made 18 December 1736

Executor = Daniel Bateman (son)

 

In the name of God Amen the eighteenth day of December in the tenth year of the reign of our Sovereign Lord George the Second by the Grace of God of Great Britain France and Ireland King and defender of the faith and so forth and in the year of our Lord One thousand Seven hundred and thirty six, I Jonas Bateman of Wyke in the parish of Birstall and County of York, Yeoman, being somewhat Infirm in Body but of Sound and perfect mind and memory do make publish and declare this my last Will and Testament in manner and form following

 

Firstly and principally I recommend my Soul into the hands of Almighty God trusting through the merits and mediation of my Lord and Saviour Jesus Christ to have pardon and remission of all my Sins; and my Body I Commit to the earth to be decently buried according to the discretion of my Executor hereafter named; and as to my temporal Estate which God in his Goodness hath pleased to bestow upon me I give and dispose thereof as following

 

First I will that all my just debts, legacys, and funeral expences (sic) be justly paid and discharged out of my personal Estate by my Executor hereafter named

 

Also I give and bequeath unto Susannah Bateman my dear and loving wife one Bedd (sic) and Bedding, one Chest, two Chairs and one Silver Spoon from and immediately after my decease; also I do further give and bequeath unto my dear and loving wife Susannah all that Messuage Tenement or dwellinghouse Barn and Outbuildings with their appurtenances called and known by the name of Bollshous situate in Northowram in the said County of York and all the seven closes of land with their appurtenances to the said Messuages or tenements belonging now in the tenure or occupation of Abraham Pyerah or his Assigns for [her] use during the term of her natural life; and from and immediately after the decease of the said Susannah my wife I give devise and bequeath the said Messuage Tenement or dwellinghouse called Bollshous Lands Closes and premises herein above more particularly mentioned unto my Son Jonas Bateman of North Bierley in the County of York, Yeoman, his heirs and Assigns forever to have and to hold the said Messuage or Tenement & Barn Outbuildings Closes of Land and premises with their appurtenances unto the said Susannah my wife from and immediately after my decease for and during the Term of her natural life (She Committing no waste or destruction thereon)

 

And from and immediately after her decease then unto the said Jonas Bateman my Son his heirs and Assigns forever; All which said premises or greatest part thereof are copyhold and holden of the Lord of the Mannor of Wakefield and which I have surrendered unto the Hands of the Lord of the said Mannor according to the custom thereof To the use and behoof of such person and persons Estate and Estates Limitations and purposes in, I should in and by my last Will and Testament in writing under my hand and Seal attested by three or more credible Witnesses give devise limit and appoint the same (which are by these presents limited appointed and declared) and by the said Surrender or memorial thereof reference thereunto being had more plainly may appear

 

And I also give devise and bequeath unto Daniel Bateman my other Son and his heirs all those three Closes of Land arable meadow or pasture with their and every of their appurtanences being freehold lying and being in Wyke aforesaid commonly called and known by the several name or names of Follingworth Close, the Mapple Jug, and the Pease Close now in my own occupation; and I do likewise give devise and bequeath unto the said Daniel Bateman and his heirs all that one Cottagehouse situate standing and being in Lightcliffe Street in the said County of York Together with all ways paths passages waters watercourses Commons Commodities Easments (sic) Emoluments, hereditaments and appurtenances whatsoever to the said Messuage or Tenement Closes of land and Cottage house belonging or in anywise of Right appertaining

 

But in case my said son Daniel Bateman shall happen to dye (sic) without Issue of his Body lawfully begotten or to be begotten Then I do hereby order, and my will and mind is, that from and immediately after the decease of the said Daniel Bateman the aforesaid Cottagehouse and three Closes of Land to him by me hereby given and devised shall go and be given to my said son Jonas Bateman’s children equally amongst them share and share alike [this suggests that Daniel had no children or wife living in 1736]

 

All the Rest Residue and Remainder of my personal Estate I give and bequeath to my said son Daniel Bateman his Heirs and Assigns for ever

 

And lastly I do nominate constitute and appoint the said Daniel Bateman Sole Executor of this my last Will and Testament hereby revoking all former Wills by me heretofore made

 

In Witness whereof I the said Jonas Bateman, the Testator, have to this my last Will and Testament contained in one Sheet of paper Sett (sic) my hand and Seal the day and year first above written – the mark of Jonas Bateman

 

Signed published sealed and declared by the Testator to be his last Will and Testament and in the sight and presence of us who in his presence and at his request have set our Names as Witnesses hereunto -- Joshua Wilkinson – Timothy Ramsden – Timothy Bentley.        passed 20th Jan: 1742
