daie of November in the yeares of the kinge of our most gracious
So’aigne lord James That is to saie of England France and
Ireland the 14th and of Scotland the 50th
defender of the faith 616 I Robert bate of Newton in Makerfield
in the Countie of Lancs Butcher sicke in body but of good and
p’fect memorie laud and praise be unto Almighty god doe make and
ordeigne this my p’sent testa’nt and last will in mann’r and
forme followinge That is to saie first and above all things I
Commend my Soule into the m’cifull custodye of my lord & Saviour
Jesus Christ trusting through his Blessed passion to be made one
of the elect number and whenyt shall please his devyne power to
sep’at my body and sule then I will that my body be buried at my
p’ish Church of Winwick theire to rest untill yt please god to
raise yt up in the last daie and make yt glorious And for the
distribution of my wordly things yt is my will and mynde to have
them bestoed in such mann’r and forme as heireafter in this
p’sent is mencioned and exp’ssed That is to saie first I geeve
grant bequeath and Assigne unto Ellen my nowe wyef All my
intterest Claime and tytle of my messuag farme and ten’ent w’th
thapp’ten’nce in Newtonaforesaid to have and to hould to the
said Ellen Bate my nowe wyef and her asignes for and duringe All
the terme conteyned and mensioned in one Indenture of lease made
bewteene the Right wor’ Sir Richard Fleetwood of Caldwiche in
the Countie of Statford knight and Baronet ot the one p’tie And
mee the saide Robt Bate of the other p’tie Bearing the date the
thridd daie of Oct’b’r in the yeares of his Ma’ Raigne above
said Together w’th the originiall lease theireof in wrytinge
Conc’inge the same for the rents suits and s’vic’s due and
accustomed to be yeilded paid and done for the same, And as
conc’inge all the rest of all and singular my goods and Cattells
affore my debts paid yt is my will and mynde to have them
devyded in twoe severall p’ts sotheire of I geve one p’t or
halfe unto Ellen my nowe wyef Andthe other I res’ve unto my
selfe It’m I geve unto my sister Alice Smyth 40s and Raffe bate
and Robt Spakman to put forth for her best use and commoditie
during her lyef And after her deceasse to remaine and bee to the
children of Richard Smyth her husband to be devided equallie
amongst them And my will is further that the said Richard Smyth
shall have the use p’te theireof But onelie to remaine and bee
to the use & behoose of the said Alice and her children as
aforesaid It’m I give to my sister Ellen 40s It’m I geve unto
Cicely Bate daughter of Richard Bate deceased 6s 8d It’m I
geve unto my brother Raffe Bate 40s It’m I geve unto each
godchild whom I am godfather unto 2s That child of my brother
John whom I am godfather unto 3s 4d It’m I geve unto my
brother John 5s and unto either of his young children 2s It’m
I geve unto Ann and Ellen Loton daughters of Raffe Loton either
of them 10s It’m I geve unto Elizabeth Kenion daughter of John
Kenion 10s It’m I geve unto William Cheshire and his wyef
either of them 2s 6d It’m I geve unto Raffe Loton and his wyef
either of them 2s 6d It’m I geve unto Raffe Bate 5s It’m I
geve unto Robt Bate 5s It’m I gev unto Rog’r Mason the younger
and Rog’r the eld’r either of them 3s 4d And unto the wyef of
Roger Mason 6s 8d It’m I geve unto Ellen Masone 3s 4d It’m
I geve unto John Kenion 5s It’m I geve the overplus and residue
of my said goods and Cattells over & besydes the discharginge of
my finall charge & expeasses and theis legacies aforesaid
excepted unto Ellen my said wyef and Raffe bate my brother to be
equally devyded between them And I ordeigne Constitute and make
the said Ellen my wyef and Raffe my brother my true and lawfull
executors to see this my last will and testam’t fulfilled in all
points And I desyer John Bate my brother and Raffe Loton to bee
sup’vis’s of the same.
