The Will of William Ayling

 

In the Name of God Amen

I William Ayling the Elder of the parish of Stedham in the County of Sussex Yeoman revoking all former wills by me made do hereby make and declare this to be my last will and testament in manner and form following and first being heartily sorry for my Sins past and humbly begging forgiveness of God for the same I recommend my Soul to Almighty God hoping to be saved by and thro’ the meritts death and passion of Jesus Christ my only Saviour and Redeemer and my Body I Comit to the Earth to be decently buried in Christian Buriall in such manner as to my Executor hereinafter named shall seem meet and as to my temporal Estate with which it hath pleased Almighty God to bless me I do order give and Dispose thereof as followeth -

Imprimis I will that all my just Debts be well and truly paid by my Executor

Item  I give and devise unto William Ayling my only Son and Heir all that my Messuage or Tenement and Lands with their appurtenances by the name of freehold situate lying and being in the parish of Kirdford in the said County of Sussex containing by estimation Eighty Acres (be the same more or less) and now in my own Occupation or my Assigns To hold the same premises with the appurtenances unto my said Son William Ayling his Heirs and Assigns for ever Subject nevertheless to the payment of the payment of the several Legacies hereinafter mentioned (that is to say) First I give and bequeath unto my Daughter Mary Ayling the sume of Two hundred pounds of lawfull money of great Britain to paid unto her by my Executor within Six months next after my Decease

Item I give and bequeath unto my Daughter Ann Ayling the Sume of Two hundred pounds of lawfull money of great Britain to be paid unto her by my Executor within Six months next after my Decease And in case my said Son William Ayling shall make default in payment of all or anny of the Legacy or Legacyes before mentioned at such time and times as they ought to be paid according to the true Intent and meaning of this my will that then and in such case I do hereby give will and devise to such Legatee and Legatees to whom such default of payment shall be made as aforesaid All and Singular my aforesaid Messuages or Tenement and Lands with the Appurtenances called Freehold To hold to such Legatee and Legatees her and their Heirs Executors and Administrators untill She or They shall out of the Rents Issues and profitts of the premises be firstly paid and Satisfied her and their respective Legacy and Legacies with Interest and damages And Lastly (after my just Debts and Legacies are paid and my funeral Expenses are discharged  All the rest residue and remainder of my moneys Goods Cattle Chattles and personal Estate whatsoever I give and bequeath unto my said Son William Ayling whom I make Executor of this my last Will and Testament

In Witness whereof I have hereunto set my Hand and Seal this Tenth day of June in the Second year of the reigne of our Sovereign Lord King George the Second over great Britain &c Anog.? Dni? 1729 – Will Ayling

Signed sealed published and declared by the said William Ayling the Testator as and for his last will and testament in the presence of us who subscribed our names a witnesses in his presence:-

 This will was proved before Mr William N? Clerk Master of Arts Surrogate of the &c Sixteen day of February 1733 by the Oath of William Ayling natural and lawfull son of the said deced and Executor &c to whom  &c well and truly &c sworn serving &c
