This is the last will and testament of me,
Thomas Hotham Archbell of Tadcaster in the County of York Joiner
and Cabinet Maker. I give and bequeath unto Amelia Harle of the
City of York the sum of one hundred pounds to be paid six months
after my decease and in case of her death before that period I
give and bequeath the same amongst her lawful issue if any,
share and share alike on attaining the age of twenty one with
interest in the meantime. I give and bequeath to John Clough
the son of Nathan Clough of Tadcaster aforesaid Wheelwright all
and every my stock in trade hardware working tools wood timber
and all articles and things belonging to my business as a joiner
and cabinetmaker to and for his own use and benefit subject to
the payment of any debt I may owe to Mr James Maude of Leeds
Timber Merchant which I direct to be paid by the said John
Clough. I give and bequeath to my housekeeper Hannah Arnold for
and during the term of her natural life sufficient furniture to
furnish two rooms which shall be chosen by her out of my
household furniture and after her decease I give and bequeath
the same to be divided equally amongst Robert Hartley, Mary
Hartley and Jane Hartley, the children of the late William
Hartley of Tadcaster aforesaid Brewer. I give and bequeath to
my godson John Fletcher the son of Joseph Fletcher of Tadcaster
aforesaid my watch and appendages. I give and bequeath to the
said Robert Hartley my silver cup or tankard marked R R A. I
give devise and bequeath until Henry Waterhouse of Tadcaster
aforesaid Joiner and Cabinetmaker and to Joseph Fletcher of the
same place Farmer all and singular my messuages dwellinghouses
lands and premises situate at Tadcaster aforesaid subject to the
mortgage affecting the same. And also all and singular my
personal estate monies book debts household furniture
stock-in-trade tenant right and personal estate whatsoever not
hereinbefore by me specifically bequeathed to hold the same
according to the different natures or tenures thereof unto them
the said Henry Waterhouse and Joseph Fletcher and the survivor
of them and the executors or administrators of the survivor of
them. Upon the several trusts following that is to say. Upon
trust in the first place to convert the whole of my personal
estate to them bequeathed into money and to pay thereout my just
debts funeral expenses and the costs of proving and registering
this my will and the said legacy of one hundred pounds to the
said Amelia Harle or her issue. And upon further trust to place
the remaining monies arising from such conversion into money out
on such security as shall be deemed sufficient by my said
trustees and to pay the interest thereof and also the rents and
profits of my said real estates after deducting the interest of
the mortgage thereon unto my said housekeeper Hannah Arnold for
and during the term of her natural life which said interest
rents and profits I hereby direct is not to be subject to the
debts control or intermeddling of any husband she may marry and
I declare the receipt of her the said Hannah Arnold
notwithstanding any covertures shall be from time to time a
sufficient discharge to my said trustees for such interest rents
and profits. And from and after the decease of the said Hannah
Arnold I direct my said trustees to transfer my said real estate
if the same shall not have been sold under the power of sale
hereinafter contained and the securities upon which my personal
estate shall be invested unto the said Robert Hartley, Mary
Hartley and Jane Hartley their heirs executors administrators or
assigns the real estate and tenants in common and personal
estate share and share alike. And my will and mind is that if
any said trustees shall at any time think it advisable to sell
and dispose of my said real estate then I hereby empower them so
to do either by private sale or public auction and I declare
that the receipts of the said Henry Waterhouse and Joseph
Fletcher or the survivor of them or the executors and
administrators of the survivor of them shall be a sufficient
discharge to any purchaser of my said real estate for the
purchase money for the same and that such purchaser shall not
afterwards be liable to see to the application of such purchase
money. And in case of such sale I direct the proceeds thereof
to be applied upon the same trusts as I have hereinbefore
directed the residue of my personal estate to be applied upon.
And I hereby declare it to be my will and mind that it is my
wish that the said Henry Waterhouse shall have the preference of
succeeding me as tenant to the quarries and lands which I occupy
on Bramham Moor in the parish of Tadcaster and that the said
Joseph Fletcher shall have the preference of succeeding me as
tenant to the farm I occupy at Stutton in the said parish.
Subject to the same tenant-right in respect of all the said
lands I should be entitled to were I leaving the same as an
offgoing tenant the proceeds whereof I declare tobe part of my
personal estate. And I do hereby nominate constitute and
appoint the said Henry Waterhouse and Joseph Fletcher joint
executors of this my will hereby revoking all former wills by me
made. In witness whereof I the said Thomas Hotham Archbell have
hereunto set my hand and seal this twenty sixth day of September
one thousand eight hundred and forty eight.

This is a codicil to my last will and
testament hereinbefore written. I give devise and bequeath my
pew in the parish church of Tadcaster in the County of York to
the said Henry Waterhouse and Joseph Fletcher in my said will
named. To hold the same to them and the survivor of them and
the heirs executors and administrators of the survivor of them.
Upon the same trusts as are expressed and contained in my said
will respecting my messuages dwellinghouses land and premises
therein devised and bequeathed and subject to the same power of
sale as is therein aforesaid of an concerning the same. In
witness whereof I the said Thomas Hotham Archbell have hereunto
set my hand and seal this twenty eighth day of September one
thousand eight hundred and forty eight.

28 October 1848 Henry Waterhouse of
Tadcaster in the County of York Builder and Joseph Fletcher of
the same place Farmer the joint executors named in this the last
will and testament with a codicil annexed of Thomas Hotham
Archbell late of Tadcaster aforesaid in the Diocese of York
Joiner and Cabinet maker deceased were sworn well and truly to
execute and perform the same; and that the whole of his personal
estate and effects within the Diocese of York do not amount in
value to the sum of four hundred and fifty pounds. Died 4
October 1848
