The Will of Amelia Anning

 

Amelia Anning died 12 June 1858

 

This is the last Will and Testament of me Amelia Anning of Lyme Regis in the County of Dorset Widow I appoint my ffriends Simeon Anning Gentleman and Edward Brown Ironmonger both of Lyme Regis aforesaid joint Executors adn Trustees of this my Will All my Plate jewellery   .... and Books I intend to divide into three Lots during my lifetime and to mark each lot with the name of one of my three Sons Charles Churchill Anning Frederick Anning and Albert Anning And I direct my said Executors to give to each of my said sons the lot so marked for him by me I give my Portrait of the late Miss Mary Anning the Geologist to my youngest son Albert Anning All the residue of my estate whatsoever and wheresoever I give and bequeath to my said Trustees their Executors Administrators and assigns Upon Trust either to allow the same to remain in its present state of investment or at their discretion to convert and get in such residuary estate and invest the money to arise therefrom in the names of my said Trustees on any investment they may deem safe and proper And upon trust to apply a competent part of the income arising from the investment of my said residuary estate in and towards the maintenance and Education of my said Son Albert until he shall attain the Age of twenty one years And subject to such last mentioned trust Upon Trust to divide my said residuary estate equally between my said three sons and their respective executors administrators and assigns I declare that it shall be lawful for my Trustees in their discretion during the continuance of but  without prejudice to the trust hereinbefore contained for the benefit of my youngest son Albert (should my trust estate be suffered to admit thereof) to advance or to apply in or towards the advancement in life of each or any of my said sons any part or parts of his share of my trust estate I empower my said trustees to give receipts for all...and effects to be paid or delivered to such trustees by virtue of this my Will and declare that such receipts shall exonerate the persons ...ing the same from all liability to see to the application of the money or effects therein mentioned And I exempt each of my said trustees from liability for losses occurring without his own default and authorize him to retain and allow to his Cotrustee all expenses incidental to the trusteeship Lastly \i revoke all former Wills In Witness whereof I have hereunto set my hand this twenty seventh day of May one thousand eight hundred and fifty eight – Amelia Anning
