This is the last
Will and Testament
from Samuel Alvey of
Oaker Side South
Darley near Matlock
in the County of
Derby, Gentleman.
1 - I appoint my
dear wife Eliza
Alvey and my son
William Henry Alvey
to be Trustees and
Executors of this my
Will.
2 - I give all
my real and personal
property unto my
Trustees upon trust
to carry out the
following directions
3 - I direct
that during the life
of my said Wife my
Trustees shall
permit her (a) to
use and enjoy my
household furniture
and effects (b) to
occupy or receive
the rents and
profits of the house
wherein I now reside
and the land
containing three
acres or thereabouts
now occupied by me
with the said house
and (c) to receive
for her own use two
third parts of the
annual income of the
remainder of my real
and personal
property however the
same may be
constituted or
invested and shall
pay the remaining
one third part of
such annual income
to my said son.
4 - I direct
that after the
decease of my said
wife my Trustees
shall hand to my
wife’s Granddaughter
Lucy Eliza Harrison
absolutely all my
said household
furniture and
effects and shall
hold my said house
and land now
occupied by me upon
trust to permit the
said Lucy Eliza
Harrison to receive
the rents and
profits thereof
during her life, she
keeping the same
house in repair and
insured against loss
or damage by fire in
the sum of Four
hundred pounds at
the least, and after
her death upon trust
to sell the same
house and land and
to divide the
proceeds thereof
between the child,
if only one, or all
the children equally
if more than one of
the said Lucy Eliza
Harrison who shall
attain the age of
twenty-one years.
5 - I direct
that subject and
without prejudice to
the foregoing trusts
and provisions my
Trustees shall hold
the whole of my real
and personal
property and the
annual income
thereof in trust for
my said Son
absolutely.
6 - And I revoke
all other Wills. In
witness whereof I
have hereunto set my
hand the nineteenth
day of April one
thousand eight
hundred and ninety
one.
